Referendum to renegotiate or cease Equalization participation from Alberta

Premier Notley, 

We, the residents of Alberta, request under the powers of the Alberta Election Act, for a referendum to be held with regards to Alberta's ongoing participation of Section 36 of the Canada Constitution Act. In 2018, the Government of Canada unilaterally decided on keeping the current formula with regards to transfer payments from "have" provinces to "have not" provinces. 

Subsection 36(2) of the Constitution Act, 1982 states that "Parliament and the government of Canada are committed to the principle of making Equalization payments to ensure that provincial governments have sufficient revenues to provide reasonably comparable levels of public services at reasonably comparable levels of taxation." The intention of this program is noble, and in good times allowed Alberta to give Canada financial security and stability. The current formula has allowed for abuse of the program by some of its recipients. This abuse is allowing some provinces to have better social services than "have provinces" and in some cases to be able to post multi billion dollar surpluses. 

We, the undersigned, feel that the current formula is flawed and need to be renegotiated, urgently. As it stands, Alberta sees a flight of tax revenue of approximately $20 000 000 000.00 per year while suffering a prolonged recession. Meanwhile; the Government of Quebec has been enjoying significant improvement in their financial performance, yet still receive massive payments from this program in the magnitude of over $13 000 000 000.00 per year. As it stands, there is no formula which the Federal Government has considered which would ever see Alberta as a "have not" province, allowing the Province to get a much needed helping hand up to get our economic situation back in order. 

As per the Clarity Act of 2000, the use of a referendum will bind the Government of Alberta and the Government of Canada into good will negotiations of the constitutional section. 

We request this referendum is held on the same date as the upcoming spring 2019 Provincial election. This would provide the government post-election a clear mandate to deliver results for Alberta in an accelerated fashion.
