Dear Mr Cyril Ramaphosa

We, the undersigned individuals and organisations wish to place on record the following:

- We reject and denounce the MMB (Muslim Marriages Bill).

- We have a right to religious freedoms and practice of the same.

- Part of our religious practices is the regulation of marriages, divorces and inheritance rights. These practices are in contrast with secular law, and therefore cannot be regulated, solemnised, determined or annulled by any secular Court in this country.

- Currently in the roll of the constitutional Court, a matter is set to be heard with regards to the MMB. An organisation by the name of UUCSA (United Ulama Council of South Africa) is purporting to be the sole representative of Muslims and Islamic Law in South Africa. This is a huge misrepresentation.


UUCSA DOES NOT REPRESENT ALL MUSLIMS IN SOUTH AFRICA

(WHICH INCLUDES THE JAMIATUL ULAMA SOUTH AFRICA, DARUL IHSAAN AND THE MJC) 


We write on behalf of the Muslim public of South Africa and the senior scholars, in terms of rank and seniority, to put forward our complaint that Mr. Ebrahim Bham, the Jamiatul Ulama South Africa, Darul Ihsaan and the MJC together with others who form and parade as UUCSA (United Ulama Council of South Africa), are baselessly  claiming to be the voice of  us who are the majority of Muslims.

They have no  mandate to speak on behalf of the Muslim community of South Africa. We  dissociate ourselves from  entities who are not be part of mainstream Islam.

We do not feel comfortable being represented by a body that we do not feel to be part of main stream Islam as their interpretation is in stark contrast to ours, or rather the true tenets of Islam.


The likeness of which is getting a Christian to represent Islam or vice versa.


We would like to point out the following:


• They do have a following, and represent them only.


• There are many Muslim organisations, institutes of higher Islamic Learning, other organisations and the Muslim public that they do not represent, and as such their representation is false as the above makes up the majority of Muslims. They have lost a lot of support within the Muslim community in the last year as well.


• There was not vote or polls to vote them in to represent Muslims and this is against democracy and we live in a democracy. As such they have no mandate and are self-appointed which goes against democracy and our constitution.

• No single organisation can represent all Muslims in our country as there are many different interpretations being made to the Laws of Islam by UUCSA and others which goes against the tenets of our faith and our most senior scholars in this country do not support them.

There many sects that do not agree on major matters regarding our beliefs and practices. Many are not regarded as Muslims but have a separate faith as per their beliefs. They do not represent them as well but claim to speak for them.

We have requested that they furnish us with the exact number of Muslims they represent as well as the number of Senior Theologians. They did not reply to us nor furnish such.


We find that although they claim to represent 400 Mosques and 200 Educational institutes, we do not have a breakdown of this nor numbers of people and Senior theologians they represent.

The teachers and institutes that they studied under also condemn their actions and interpretations.

There is no valid basis for the President to accept Mr.Bham, MJC and UUCSA as being the representatives of the Muslim community.

We trust that in keeping with the constitution the president would review this and place some procedure in place to address our grievance, and our grievance is that UUCSA nor its affiliates represent the majority of Muslims and as such they have no right to engage with government on our behalf.
