With reference to above subject and reference number I would like to bring your kind notice as below.

1.      Kindly refer above reference A & B my appeal to NPCIL board of director as on dated I have not received any acknowledgment from concerned authorities of NPCIL or interim reply or NPCIL board of directors decisions as per laid down principles.

2.       In related PUC, ID Note No. 031/1/1/2009-TS dated 04/08/2011 cabinet secretary Rashtrapati Bhavan my representation dated 27/06/2011. Requested to provide photocopy correspondence, communication, clarification, final report and action taken concerned authorities on the basis of final report has mentioned in the noting sheets, communication to Dr Sreeramappa etc under RTI act and also suspended from service memorandum of records, but failed provide the required records by concerned authorities.

3.      As per NPCIL Disciplinary and appeal rules, 1996 (Amended up to April 2014) I supposed to get NPCIL board of director decision within 3 months.

4.      With reference to No.NPCIL/HQ/VIG/4(4)/2013/233/216 dated 15.10.2013, please refer point No.8.0, Recommendation for action (8.1-8.9)  and 9.0 Recommendations for system improvements  , as on dated not implemented hence there is lot of corruption ,irregularities and malpractices in the department. Surprisingly Mr. Prateek Goswami CVO of NPCIL has not done follow up to implement effective manner, hence CVO may be involved with management in corrupt practices. Please refer List of NPCIL HQI’S revision due ANNEXURE-A page 01-20, the HQI since from many years not reviewed and there is no HQI framed, example uniform system for NPCIL Hospitals. Hence there are lot of corrupt practice, irregularities and malpractice going on in higher level of management authorities.     

5.      As per HQI-1035 (R-2)-Guideline for effective transfer of employees within NPCIL- Identification of sensitive posts for rotational transfer ANNEXURE-B page 01-03 As per laid down principles either NPCIL are not following strictly or Mr. Prateek Goswami CVO of NPCIL has not done follow up to implement effective manner.

6.      Please note that Mr.K.C.Purohit Ex-NPCIL CMD and  Mr.S.K.Sharma, NPCIL CMD themselves practicing or practiced without appointing Sr. Principle Private Secretary to the CMD office. Please refer Mr.Sachin Kadale Sr.PS to CMD appointment tract records since from his appointment to PA to Director (HR) as on dated is totally arbitrary, prejudice, malafide intention and conflict of interest. Article 16 of the constitution provides for equality of opportunity for all citizens in matters relating to employment or appointment to any office under the state and Right to Equality, fundamental rights of the Constitution of India. Article 14,

As per HQI 1002-A, point No.4.5.5 and 4.5.6, the senior principle private secretary is meant for the office of chairman and managing director and shall be operated. As per HQI 1002-C, point No.4.0 of 4.1, as per laid down principles the principle private secretary should be posted in the CMD and Directors in the board of directors office as per seniority. Surprisingly there is lot of irregularities, malpractice, veto power, arbitrary and violation of
Article No.14 & 16 of constitution.

Mr.S.J.KADALE senior private secretary junior to 9 principle private secretary’s and 49 senior private secretary’s employee of NPCIL is operating NPCIL chairman and managing director office. Mr.S.J.Kadale was posted to director (HR) office during Mr.S.B.Agrakar Ex-director (HR) period as PA (personal assistant) during that time not appointed either senior private secretary or principle private secretary, the PA was managed director (HR) office. Before joining director (HR) office he was active leader of trade union and SC/ST Associations. He was transferred to Mr.K.C.Purohit Ex-Director project office as PA, during that time not appointed either senior private secretary or principle private secretary; the PA was managed director (project) office. When Mr.K.C.Purohit has got promotion as CMD of NPCIL Mr.S.J.Kadale was posted to CMD office surprisingly either Mr.K.C.Purohit  Ex-CMD of NPCIL or Mr.K.S.Sharma present CMD of NPCIL has not appoint senior principle private secretary post or not appointed as per seniority. It clearly shows that lot of irregularities, malpractice; corrupt practice, veto power, arbitrary and violation of Article No.14 & 16 of constitution. When CMD himself not following any rules and regulation what is the fate of this NPCIL organization? Country?. ANNEXURE-C page 01-08.

7.      Government of India Ministry of Railways No.2008/V-1/CVC/1/4 New Delhi, Dated, August 11, 2008, the CVO has identified Rotation of officials working in sensitive posts, but Mr. Prateek Goswami CVO of NPCIL failed to include many sensitive posts by involving with NPCIL management the few example as below.

7.1  Posts on which Doctors are nominated for conducting PME and      medical examination for new recruits (Certifying surgeon posts).

7.2  Senior Scale and above personal Secretary, Sr. personal Secretary and principle private Secretary.

7.3  Pharmacists looking after the drug stores.

7.4  Clerks/Pharmacists dealing with Periodical Medical Examination.

7.5  Staff dealing with passing of medical re-imbursement bills to non NPCIL hospitals.

7.6  Medical Superintendents posts.

7.7  And many more as mentioned in the Government of India Ministry of Railways No.2008/V-1/CVC/1/4 New Delhi, Dated, August 11, 2008 has not included in the NPCIL sensitive posts.

8.      As per NPCIL RTI replay in related to the sensitive posts ANNEXURE-D page 01-49as per laid down principles either NPCIL are not following strictly or CVO of NPCIL has not done follow up to implement effective manner.

9.      As per HQI-9003(R-2) Guidelines for Role, job, task, functions and responsibilities of Vigilance Directorate at Headquarter/Unit which is not being adhered to on the following points by Mr. Prateek Goswami CVO of NPCIL ANNEXURE-E page 01-16

9.1  As per No.NPCIL/HQ/VIG/4(4)/I/CRR-40/3582/2017/322 dated 30.05.2017, Mr. Prateek Goswami CVO of NPCIL is totally unjustified, malafide intention, arbitrary, prejudice, It is a gross or willful negligence, recklessness, exercise of discretion without or in excess of powers/jurisdiction, causing undue loss to the organization or a concomitant gain to an individual and flagrant violation of systems and procedures. ANNEXURE-F page 01-13

9.2  5.0 (9) Not protecting and strengthening hands of ‘whistleblowers’ in my case.

9.3  6.0(6.6) Delay in decision making not taken merits of the decision in my suspension, memorandum and Board of appeal in related penalty order by Mr.S.K.Sharma, CMD & DA NPCIL. It is a gross or willful negligence, recklessness, exercise of discretion without or in excess of powers/jurisdiction, causing undue loss to the organization or a concomitant gain to an individual and flagrant violation of systems and procedures.

9.4  6.7 Prateek Goswami CVO of NPCIL failed to perform his function in my case pertaining to Preventive, Punitive Vigilance, Surveillance and Detection.

9.5  7.0 A.6 (a) With reference to above subject, Delay in decision making not taken merits of the decision in my suspension, memorandum and Board of appeal in related penalty order by Mr.S.K.Sharma, CMD & DA NPCIL. It is a gross or willful negligence, recklessness, exercise of discretion without or in excess of powers/jurisdiction, causing undue loss to the organization or a concomitant gain to an individual and flagrant violation of systems and procedures.

9.6  6(b) there is undue/unjustified delay in the disposal of my case in my all grievances, disciplinary proceedings. Hence my case comes under Vigilance angle. But Mr.K.C.Purohit Ex-CMD, Mr.S.B.Agrakar Ex-director(HR) Mr.S.K.Sharma, CMD & DA NPCIL, Mr.Nagaich director (HR), and Mr. Prateek Goswami CVO of NPCIL has caused  gross or willful negligence, recklessness, exercise of discretion without or in excess of powers/jurisdiction, causing undue loss to the organization or a concomitant gain to an individual and flagrant violation of systems and procedures

9.7  9.0 Functions and responsibilities of Directorate of Vigilance in NPCIL failed to follow the work of the Directorate covering following 6 activities Vigilance Administration, Preventive Vigilance, Punitive Vigilance, Technical Vigilance, Surveillance and Detection, Vigilance clearance in my case.

9.8  9.5.1 Examination by CTE. Supply of medicines-4 largest Value contracts kindly refer my complaint number: 59274/2014/Vigilance 6, dated 16/12/2014, as on date not investigated the case.

9.9  10.1.2 Duties and Responsibilities With reference to No.NPCIL/HQ/VIG/4(4)/2013/233/216 dated 15.10.2013, , please refer point No.8.0 Recommendation for action (8.1-8.9)  and 9.0 Recommendations for system improvements , as on dated not implemented hence there is lot of corruption ,irregularities and malpractices in the department, he has not performed his duties and responsibilities as on date.

9.1011.0 Handling of complaints. NPCIL CVO failed to handle my all complaints.

9.11     12.0 Reports and Returns. NPCIL CVO may have sent periodical reports which may not be factually true, he may have produced false records due to malafide intentions.  

10.  With reference 72564/2017/VIGILANCE-6/342952 dated 02/05/2017, Prateek Goswami CVO of NPCIL has not done follow up to implement effective manner in related to the above point No.3, in such situation I will not get justice from Prateek Goswami CVO of NPCIL.

11.  During Mr.Sushil Chand Ex-CVO of NPCIL service period my all grievances are examined by him and investigated but Mr. Prateek Goswami CVO of NPCIL has not investigated my all grievances even though I submitted lot of evidences.

11.1                    Please refer my grievance Letter No.DR.SR/TMS /CVC -24/2013, Dated; 30/08/2013 and Letter No.DR.SR/TMS /CVC -26/2013, Dated; 12/11/2013, in related More than 1000 Crores of LTC scam/racket in NPCIL and DAE. I surprised nearly 4 years after my complaints department has started recovering money along with huge penalty   interest, is totally unethical, prejudice, arbitrary and malafide intention. The employees are innocents due to management wrong system or default why employees have to punish? The concerned authorities of NPCIL CMD, director (HR) and director finance supposed to be punished but Mr. Prateek Goswami CVO of NPCIL to safeguard to NPCIL CMD, director (HR) and director finance the inquiry report may be given adverse to employees ANNEXURE-G page 01-02

12.  Please refer my complaint number is :59274/2014/Vigilance 6, dated 16/12/2014, in related to the Grievance against corruption in Contributory Health Service Scheme (CHSS) in Department of Atomic Energy (DAE) making loss to Government to the tune of approximate Rs. 1000  crores every year. The both DAE & NPCIL CVO may be involved with management, because as on dated not investigated the case due to high level DAE/NPCIL management involvement.

13.  Please refer my all grievances and RTI applications, Due to my SC/ST welfare association activist, RTI activist against Corruption, irregularities and malpractices in system as whistleblower, many system has improved in the department and crores of rupees government money has been saved by me  for the interest of organization and nation. In such a case CVC, Police department & ACB supposed to be protected as whistleblower but what happened? Corruption is worse than Naxalism and terrorism, is it not a crime?

14.  In view of the above it clearly shows that Mr. Prateek Goswami CVO of NPCIL not only involved with higher level of NPCIL management in related to corrupt practices, Delay in decision making and not taken merits of the decision but also not working as an independent, hence he is unbecoming of CVO in the CVC organization. It is a gross or willful negligence, recklessness, exercise of discretion without or in excess of powers/jurisdiction, causing undue loss to the organization or a concomitant gain to an individual and flagrant violation of systems and procedures.

Who will stop these corruptions? The majority of people serving at lower designations in an organization or institutes are at times ignorant and at times if raise voice are threatened or neglected by so called BOSSES. I personally do not have much faith in the in-house vigilance cell of organization since his salary and emoluments are borne by NPCIL. To perform vigilance functions the officials need to be functionally independent directly reporting to CVC. Because all big BOSSES are well linked and go equally tuned to move the wheel go ahead.
What is the result? Everywhere simple men are sufferer and some are illegally earning the money at the cost of loss of humans and national health and wealth!
My earnest request is please look into the matter at the earliest so that the further loss is prevented in the form of losing human health, losing national property and creating an example that no corruptionist can escape from people’s vigil!!
18.  The concerned authorities of management Harassing, discriminating, humiliating, creating severe mental agony, creating financial crisis even after suspension revoke/penalty also and may be once again preplanning to suspend/terminate from service to me or trying to kill me by suicide myself like more than 350 scientist has been suicided/killed due to severe mental agony/depression in DAE. 

19.  In view of that I request to restore the justice by exonerating me from suspension, memorandum of charges and penalty order.

The DAE/NPCIL being a sensitive organization directly comes under Honorable Prime Minister of India. The DEPARTMENT OF ATOMIC ENERGY Chairman and secretary misleading/misguiding to Honorable prime minster as an adviser please refer stereo type false reply to my all grievances without proper investigation.
21.  As per DOPT Order No. 11013/08/2013Estt (A)-III dated 06/06/2013, I have exhausted all in house channels, CVC, ACB, NCSC, MCI, Police department, Prime minister of India and President of India, due to injustice I am facing severe mental agony. In view of that if am not getting justice/replay within 7 days I forced to disclose public at any time under Article 51A in The Constitution Of India Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the national Flag and the National Anthem; to safeguard public property.
