So one of the many problems with the judicial system is the Domestic Violence Laws! Oh where to begin…. Here’s an example; when a woman finally has the courage to fight for herself and her children, no.1 he gets a slap on the wrist and goes back home and things get worse. No.2 she presses charges again and he is sentenced, and a protection order is in place. Only thing is that the pfa runs out while he’s in prison so she can’t extend it because there “isn’t new abuse”. He gets out of prison, almost kills her, she’s able to get another pfa (2) and he violates it again. Goes back to prison pfa runs out same situation, it expires. He gets out, another pfa gets out in place and he violates, he gets charged and goes back to prison. Pfa runs out! Do you see the viscous cycle?? The PFA can not be longer then 2 years because it’s considered to be a “first one” because it wasn’t extended the first time! Mind you, the charges he just went back to prison for was Felony Violation of a PFA!! So now here I sit, scared to death, he’s out of prison and I have to fight for another PFA!! He should be the one fighting for his freedom, or any rights! He broke the law, not me! Why am I fighting to keep my kids and myself safe from him?? After the PFAs were violated the first time and the gruesomeness of the crime, I should’ve been granted a lifetime pfa then! They don’t let you extend unless new abuse, but he’s in jail. And I can’t get a new one unless he abuses me again. But one of these times I might be dead! Or one of these times he may just follow me from court and my Protected Address won’t be so private!  Then they won’t have to worry about me filing another one! The lay now states that you file a Protection Order that only lasts 2 years, unless you extend it. But the catch is there needs to be current abuse. Which is a violation! I would like to change the rules to state that if you file a PFA the judge can make the decision on a time frame dependant on the severity of the case. If said pfa is violated, it can be revisited/revised to last longer. If a protection order is violated 3 or more times on the same victim, his prison sentence is now in felony status and should get more time. And a lifetime PFA would automatically be issued if it hasn’t been yet. Please sign this petition to help victims be free from the fear of having to reface their abuser every 2 years.
