Protect cows and their sacrifice be ban in India - Naresh Kadyan

Essence of order dt 12-11-2010 of High court of Kolkata in W.P. No 1378, 21591(W)  : The earlier decision of this court bans slaughter of cow on the occasion of Idd as religious ritual. Judgment by the Supreme court still holds good. The Authorities are, therefore bound to implement the provisions of West Bengal Animal Slaughter (Control) Act, 1950 and if any instance of cow slaughter on Bakri-id is brought to their notice, they will have to take cognizance and Act in accordance with law. It will be open for the petitioners to move this court in case they come across such incident and if the same is reported to the authorities and the authorities fail to take any action in the matter.

हाई कोर्ट के आदेश दिनांक १२ नवम्बर २०१० का सारांश 

धार्मिक क्रिया के रूप में बकरीद पर गोवंश की कुर्बानी पर इस न्यायालय का पूर्व आदेश प्रतिबन्ध लगता है, सर्वोच्च न्यायालय का आदेश अभी भी मान्य है.पश्चिम बंगाल पशु हत्या निवारक अधिनियम १९५० की धाराओं को लागू करने प्रशासन बाध्य है.  अगर बकरीद पर गोहत्या की जानकारी अगर उनके ध्यान में लायी जाती है तो उन्हें इसका कानून के अनुसार संज्ञान लेना होगा. याचिका कर्ता, अगर किस घटना की  सूचना अधिकारीयों को देते हैं और अधिकारी कोई कार्यवाही नहीं करते तो वे इस न्यायालय में पुनः आ सकते है.

सर्वोच्च न्यायालय के आदेश दिनांक १६-११-९४ (AIR 1995 के  पृष्ठ ४६४का सारांश 

        “पश्चिम बंगाल पशु हत्या नियंत्रण अधिनियम १९५०-गाय-भैंस सहित पशुओं की हत्या रोकने के उद्देश्य से बना है. राज्य सरकार वैकल्पिक धार्मिक कृत्य हेतु धारा १२ के अंतर्गत छूट नहीं दे सकती. धारा ५ के अनुसार - गाय १४ वर्ष से उपर की है या अपंग है का  प्रमाण पत्र मिलने के बाद भी,  केवल  निर्धारित स्थान (कत्लखाने) के आलावा किसी अन्य  स्थान  पर पशु का वध नहीं हो सकता. किन्तु कुर्बानी कत्लखाने  में भी नहीं हो सकती;  धारा ७ - दोषी  व्यक्ति को ६ माह का कारावास  या १००० का जुर्मना या दोनों की सजा हो सकती है; धारा ८ - यह एक संज्ञेय अपराध है. धारा ९ - अपराध करने का प्रयास करने या प्रोत्साहित करने पर भी दण्डित किया जा सकता है. चूँकि बकरीद पर गाय की कुर्बानी आवश्यक धार्मिक कृत्य नहीं है अतः बकरीद समेत सभी दिनों के लिए गायों की  हत्या पर पूर्ण प्रतिबन्धसंविधान के अनुछेद २५ (१) के विरुद्ध नहीं है. मुग़ल बादशाह बाबरहुमायूंअकबरजहाँगीर एवं अहमद शाह ने भी गोहत्या पर प्रतिबन्ध लगाया था.मुस्लिम ग्रंथो के अनुसार केवल स्वस्थ पशु की कुर्बानी दी जा सकती है ;  कानून की चर्चा से स्थिर  हो जाता है कि मुसलमानों को बकरीद पर स्वस्थ गायों की कुर्बानी हेतु आग्रह करने का कोई मौलिक अधिकार नहीं है. चूँकि गायों की कुर्बानी एक आवश्यक धार्मिक कृत्य नहीं अतः राज्य सरकार के पास भी यह अधिकार नहीं कि वह धारा १२ के अंतर्गत छूट दे सके

সর্বোচ্চ ন্যায়ালয়ের আদেশ তারিখ ১৬-১১-৯৪ সারাংশ

   “পশ্চিম বঙ্গ পশুহত্যা নিয়ন্ত্রণ অধিনিয়ম ১৯৫০; গরু-মহিষ সহ অন্যান্য পশুহত্যা আটকাবার জন্য গঠিত হয়েছে ৷  রাজ্য সরকার অতি আবশ্যক ধার্মিক কৃত্য না হলে ধারা ১২-এর অন্তর্গত মতে ছাড় দিতে পারেন না ৷  ধারা ৫ অনুসারে যে গরুর বয়স ১৪ বত্সরের বেশী এবং সেইসঙ্গে পঙ্গু, তার প্রমান পত্র নেবার পরেই শুধু নির্ধারিত স্থানে (কোতলখানা) ছাড়া অন্য স্থানে হত্যা করা যেতে পারে না ৷  কুরবানি কোতলখানায় হতে পারে না ৷  ধারা ৭ অনুসারে দোষী ব্যক্তির ৬ মাসের কারাবাস আর ১০০০ টাকা জরিমানা কিম্বা উভয় সাজা-ই হতে পারে ৷  ধারা ৯ অনুসারে অপরাধ করার প্রয়াস যে করছে কিম্বা যে উত্সাহিত করছে তাকেও দন্ডিত করা যেতে পারে ৷   যে হেতু বকরিদে গরু কুরবানী আবশ্যক ধার্মিক কৃত্য নয় বকরিদের সঙ্গে সঙ্গে অন্য দিনেও গোহত্যার পূর্ণ নিষেধ সংবিধানের অনুছেদ ২৫ (১)  এর  বিরুদ্ধে  নয় ৷  মোগল বাদশা  বাবর, হুমায়ুন, আকবর, জাহাঙ্গীর ও আহমেদ শাহ্  আইন করে গোহত্যা নিষেধ করে ছিলেন ৷ আইন-কানুনের চর্চা দ্বারা এইটি প্রমাণিত হয়েছে যে মুসলমান দের সুস্থ গরু কুরবানী করার ইচ্ছা কোনো মৌলিক অধিকার নয় ৷  যে হেতু গরু কুরবানী আবশ্যক ধার্মিক কৃত্য নয়, রাজ্য সরকার ধারা ১২ মারফত্ এতে ছাড় দিতে পারেন না ৷ “

Essence of ORDER OF SUPREME COURT DT 16-11-94 (P464 of AIR 1995)

“The Act is meant for controlling the slaughter of animals including the cows and buffaloes. State will not have any jurisdiction or power to invoke section 12 for fulfilling such optional religious practice of Muslim community.  Even if there is a certificate enabling a person to get concerned animal slaughtered he cannot slaughter it in any place other than the place prescribed in that behalf.   Section 7 - whoever contravenes the provision of the Act shall be punishable with imprisonment for a term which may extend to six months or with fine which may extend to one thousand rupees or with both.  Section 8 makes the offences cognizable under the Act.  Section 9 prescribes punishment for abetment of offences or even attempts to commit any such offence under the Act.  In other words there is total ban against slaughtering of healthy cows and other animals.  If that ban is to be lifted even for a day, it has to be shown that such lifting of ban is necessary for sub-serving any religious, medicinal or research purpose.     As slaughter of cows on Bakri Idd was not an essential religious practice for Muslims, total ban on cow’s slaughter on all days including Bakri Idd day would not be violative of Article 25(1). Mughal Emperor Babar saw the wisdom of prohibiting the slaughter of cows as and by way of religious sacrifice and directed his son Humayun to follow this.  Similarly, Emperors Akbar, Jahangir and Ahmad Shah, it is said, prohibited cow slaughter. As per Muslim books, only healthy animals can be sacrificed, but settled legal position, it becomes obvious that if there is no fundamental right of a Muslim to insist on slaughter of healthy cow on Bakri Idd day. It would be equally not open to the State to invoke its exemption power under section 12 for such a non essential religious purpose. “

सर्वोच्च न्यायालय के आदेश दिनांक १६-११-९४ का सारांश 

१. पश्चिम बंगाल पशु हत्या नियंत्रण अधिनियम १९५०-गाय-भैंस सहित पशुओं की हत्या रोकने के उद्देश्य से बना है.

२. राज्य सरकार वैकल्पिक धार्मिक कृत्य हेतु धारा १२ के अंतर्गत छूट नहीं दे सकती.

3. धारा ५ के अनुसार - प्रमाण पत्र मिलने के बाद भी,  केवल निर्धारित स्थान (कत्लखाने) के आलावा किसी अन्य  स्थान  पर पशु का वध नहीं हो सकता.

४. धारा ७ के अनुसार दोषी  व्यक्ति को ६ माह का कारावास  या १००० का जुर्मना या दोनों की सजा हो सकती है.

६. चूँकि बकरीद पर गाय की कुर्बानी आवश्यक धार्मिक कृत्य नहीं है अतः बकरीद समेत सभी दिनों के लिए गायों की  हत्या पर पूर्ण प्रतिबन्ध, संविधान के अनुछेद २५ (१) के विरुद्ध नहीं है.

७,  मुग़ल बादशाह बाबर, हुमायूं, अकबर, जहाँगीर एवं अहमद शाह ने भी गोहत्या पर प्रतिबन्ध लगाया था.

८. कानून की चर्चा से स्थिर  हो जाता है कि मुसलमानों को बकरीद पर स्वस्थ गायों की कुर्बानी हेतु आग्रह करने का कोई मौलिक अधिकार नहीं है. 

९. चूँकि गायों की कुर्बानी एक आवश्यक धार्मिक कृत्य नहीं अतः राज्य सरकार के पास भी यह अधिकार नहीं कि वह धारा १२ के अंतर्गत छूट दे सके.

Subject:  An appeal to ensure the complete prohibition upon Cow Slaughter abiding by the existing rules and regulation in force in different states in India along with the strict direction of Hon’ble Supreme Court of India.

Madam/Sir,

  1. Under the laws enforced in this land with a wide view to natural justice to all creatures, honoring the Sanatani tradition of venerated  Cow progeny even as non hittable (aghna), respecting  the Cow as Go-Mata in highest esteem in the traditional scriptures, contemplating the importance of Cow progeny in Indian agriculture, health, medicines and economics based upon its blessings upon us and obviously to be humane by resisting the animal cruelty, most of the states have been formulated its own rules and acts in favor of banning Cow Slaughter even in Bakri Idd.
  2. But, very unfortunately going to the utter contradiction to the above, in most of the cases Cow progeny are being slaughtered very cruelly in a disgusting gruesome way, sometimes with the help of local administration and politics, only to appease a minority section hurting the majority by violating all the norms so framed by the states very illegally, unreasonably and undemocratically. Though all the Hindu, Sikh, Jain, Buddhists, Arya Samajists  and the  Sanatani and Vedic followers want a total ban on cow slaughter in Bharat, as a matter of humiliation of all Bharat Dharma, the rampant cow slaughter is going on violating all the norms in force.
  3. As an example, the state of West Bengal, now Paschimbanga had given permission in the last year to slaughter Cows in Bakri Idd under the section 12 of the WB Animal Slaughter Control Act 1950, very intrigue-fully going against the verdicts of Hon’ble Calcutta High Court and the Hon’ble Supreme Court of India.
  4. It is a wide known fact that being aggrieved Sri Kedar Nath Brahmachari and 26 others filed a petition against the State of West Bengal and 20 others for which Hon’ble Calcutta High Court passed an order to ban cow slaughter even in Bakar Idd, vide 1982(2) Kokata, HN dated 20.8.1982.
  5. The State of West Bengal filed an appeal in Supreme Court of India against the above order of Calcutta High Court vide CA 6790/1983 – State of West Bengal & Others. –vs– Ashutosh Lahiri & Others. for which the Hon’ble Supreme Court maintained the order of Calcutta High court to prohibit the Cow slaughter in Bakri Idd  as such slaughters being unconstitutional and directed the State to take measures to stop such illegalities.
  6. Despite of that in West Bengal and other States at least 30 lakhs (5 lakhs in West Bengal) healthy, milky, cultivating and capable Cow progeny are slaughtered very unfortunately within a political nexus of Chairman, Sabhapati of Panchayet Samity and the official authorities in various departments.
  7. As aggrieved by the gross violation of the Slaughter Control Act enforced in different States time and again and felt detrimental to the majority Hindu sentiment in general, various forums filled many petitions in the designated Courts for getting justice to stop cruelty upon animal and especially mentionable the petitions filed in the Honb’le Calcutta High Court by Akhil Bharat Krishi Go Seva Sangha, Arya Pratinidhi Sabha, Sri K K Singhania, Sri Abhijit Das & Enamul Haque and others.
  8. It is also mentionable that the esteemed Islamic Institution “Darul-Uloon-Deoband” also declared a Fatwa describing not mandatory to slaughter cows in Bakri Idd and requested not to do such accordingly. The extract of the Fatwa can be obtained from the news published in Dainik Jagran dt. 13.06.2006.
  9. But unfortunately, the chain of illegal slaughter is in vehemently increasing, killing healthy, capable and milking cows, while the children of the poor families are dying do to malnutrition and don’t get a single drop of cow milk in this land of “Gopal”. As per report of the UNICEF entitling “World Children Status Report-2008”, every day 5000 children are dying in India due to malnutrition.
  10. It is well established that the Cow progeny is the foundation of our agriculture, health, conventional & renewable energy source and the all round development of this Sanatani Land with a highest veneration to Go Mata and Go Palak (Cow Savers). And butchering these very calm and pretty animals hitting the religious sentiments of Hindus must attract the provisions of Section 153 and 295 of Indian Penal Court.
  11. Again, a Seven Judges Bench in the Honb’le Supreme Court of India gave the verdict in CA No.4937-4940 of 1998 being the case of State of Gujrat & Others Vs. Mirajapur Moti Kureshi Kasab & Others.  [2005/ SCCL.Com-735] propounding the importance of Oxen over the age of sixteen years for their utility in case of agricultural manure and recycling energy production from its dung and urine and consequently prohibited oxen slaughter even over 16 years of age of it.
  12. Cow slaughter is completely prohibited without any discrimination of age or condition inDelhi, Haryana, Punjab, Himachal Pradesh, Jammu & Kashmir, Rajasthan, Madhya Pradesh, Chattishgarh, Bihar, Jharkhand, Uttarakhand, Gujarat etc., but the total prohibition of Holy Cow progeny in the length and breadth of this Holy Land is still awaited within a suitable Constitutional amendment.  On the other hand the violation of existing slaughter prohibitory rules and regulations are inciting the Hindu sentiments by some communal elements finding the loop holes of the police and administrations by the way.

In this context, these are our earnest requests to the effect that:

A. Please maintain and give full protection to the Prohibitory Acts on Cow Slaughter on Bakri Idd this year on 7th November, 2011 and to extend full cooperation and security to all forums to restrain these illegal slaughters in their activities to help the police and administration on spot of occurrence of illegal slaughters in every state, especially in West Bengal.

B. Please form a task force in each level comprising Govt. officials and the related NGOs to restrain illegal cow slaughter in every place, especially in West Bengal. Please stop all Cow markets set up for Bakri Idd and ban interstate import-export of cow progeny for slaughter as a mandatory measure.

C. Please apply the provisions of National Security Act (NSA) against the perpetrators for the violation of Animal slaughter Control Acts.

D. Please set a high strategy team for banning all type of Cow progeny slaughter under illegality and to monitor the prohibition and utilization through videography in surface and even through helicopter in the disturbed area due to cow slaughter.

E. Please start legal proceedings against BDO (Block Development Officer) and the Officer-In-Charge of the Police Station of the respective Block and the police station where the cases of illegal cow slaughter may occur violating the existing rules and regulations.

F. Please construct the Cow Rehabilitation Center in each district to maintain the rescued Cows and Oxen from illegal slaughter with a coordination of the various “Gosewa Goraksha Sangathan”  (Cow Rehabilitation & Protection Organizations) for a sustainable development of Indian agriculture, health, economy, energy, traditional medicines and ecology.

As per Law of Land - West Bengal Animal Slaughter Control Act 1950, Sacrifice of Cows on Bakrid – is illegal because it is not an essential religious requirement. High Court decided this after 12 Years that it is not essential religious requirement. West Bengal Government appealed against order of HC in Supreme Court. On 16-11-94, Supreme Court also delivered its final VERDICT striking down the appeal of West Bengal Government; giving detailed references of HISTORY. Thus sacrifice of COW PROGENY is illegal as per law of land; as clarified by Supreme Court. Thereafter also 15 years have passed, wherein you have not taken adequate action. Thus the crime of killing cows on Bakrid in increasing year after year due to inaction of Police department. West Bengal and India as whole has lost great amount of its most precious cattle wealth in these 29 years. This is 30th year. Kindly do take action soon to stop the crime. People in north do not believe that such a large number of cows are openly sacrificed and Police is silent spectator. Cows from all parts of India come to Bengal for agriculture or MILK purpose, But half of them are killed here and half is exported illegally to Bangladesh.
Many Muslims and Muslim organizations are also in favor of Cow protection. Highest Islamic body – DARUL ULOOM DEOBAND, has given many fatwa – advice not to sacrifice cows. Prophet Mohammed had said “Cow’s milk and ghee is medicine and its beef is disease.” And “I would stand against a cow killer on the day of Kayamat.” Hence kindly perform you constitutional duty to implement LAW AND ORDER=SAVE COWS.
Section 9 prescribes punishment for abetment of offences or even attempts to commit any such offence under the Act. Thus all who are taking cows are attempting to commit such an offence and you should stop them. Your inaction amounts to abetment or contempt of Supreme Court ? You may take following steps –to save dignity of LAW:
1. Advertise in print and visual media and apply posters that “Sacrifice of cow is illegal as per law of land Or essence of order of S.C. or wordings of Islam
2. Do not allow any cattle market where cows are bought and sold, stop movements of cow on every road, lanes –prior to bakrid because it is attempt to commit offence.
3. Take custody of cows prior to bakrid and return them after Bakrid or Instruct OC of all PS to count COWS before and after Bakrid
You know better what else can be done to save cows for saving dignity of LAW. Kindly do the needful soon. A Line of confirmation will be highly appreciated.
Few lines of the ORDER OF SUPREME COURT DT 16-11-94 are as follows:-
1. The Act is meant for controlling the slaughter of animals including the cows and buffaloes and this is with the object of increasing the supply of milk and avoiding the wastage of animal power necessary for improvement of agriculture; But so far as healthy animals like cows are concerned there is a complete ban on slaughtering them.
2. Therefore, it is not essential for Muslims to earn religious merit by insisting on sacrificing only healthy cows on Bakri Idd. Consequently, the State will not have any jurisdiction or power to invoke section 12 for fulfilling such optional religious practice of Muslim community.
3. No person shall slaughter any animal unless he has obtained in respect thereof a certificate under sub-section (2) or sub-section (3) that the animal is fit for slaughter. As per sub-section (2) a certificate is required to be issued by the concerned authorities that the animal is over 14 years of age and is unfit for work or breeding or that the animal has become permanently incapacitated from work or breeding due to age, injury, deformity or any incurable disease.
4. As per section 5 even if there is a certificate enabling a person to get concerned animal slaughtered he cannot slaughter it in any place other than the place prescribed in that behalf. As per section 7 whoever contravenes the provision of the Act shall be punishable with imprisonment for a term which may extend to six months or with fine which may extend to one thousand rupees or with both. Section 8 makes the offences cognizable under the Act. Section 9 prescribes punishment for abetment of offences or even attempts to commit any such offence under the Act. The aforesaid relevant provisions clearly indicate the legisla­tive intention that healthy cows which are not fit to be slaugh­tered cannot be slaughtered at all. That is the thrust of sec­tion 4 of the Act. In other words there is total ban against slaughtering of healthy cows and other animals mentioned in the schedule under section 2 of the Act. This is the very essence of the Act
5. Now it becomes clear that when there is a total ban under the Act so far as slaughtering healthy cows which are not fit to be slaughtered as per section 4(1) is concerned, if that ban is to be lifted even for a day, it has to be shown that such lifting of ban is necessary for sub-serving any religious, medic­inal or research purpose
6. It does not appear to be obligato­ry that a person must sacrifice a cow.
7. As slaughter of cows on Bakri Idd was not an essential religious practice for Muslims, total ban on cow’s slaughter on all days including Bakri Idd day would not be violative of Article 25(1).
8. In this connection, Das C.J., referred to the historical background regarding cow slaughtering from the times of Mughal emperors. Mughal Emperor Babar saw the wisdom of prohibiting the slaughter of cows as and by way of religious sacrifice and directed his son Humayun to follow this. Similarly, Emperors Akbar, Jahangir and Ahmad Shah, it is said, prohibited cow slaughter.
9. In view of this settled legal position it becomes obvious that if there is no fundamental right of a Muslim to insist on slaugh­ter of healthy cow on Bakri Idd day, it cannot be a valid ground for exemption by the State under section 12 which would in turn enable slaughtering of such cows on Bakri Idd
10. Similarly it has to be held that if it is not necessary or essential to permit slaughter of a healthy cow for any religious purpose it would be equally not open to the State to invoke its exemption power under section 12 for such a religious purpose. We, therefore, entirely concur with the view of the High Court that slaughtering of healthy cows on Bakri Idd is not essential or required for religious purpose of Muslims.

The court: These two petitions have been filed in public interest on the issue of sacrificing cow and its progeny as religious ritual on the occasion of Bakri-idd. The petition itself contains decision of this court which bans slaughter of cow on the occasion of Idd as religious ritual. Therefore no fruitful purpose will be served by again passing similar judgment and orders as the said judgment, which was upheld by the Supreme court ( State of West Bengal vs Asutosh Lahiri, reported in AIR 1995 S.C. 464) still holds good. The Authorities are, therefore bound to implement the provisions of West Bengal Animal Slaughter (Control) Act, 1950 and if any instance of cow slaughter on Bakri-id is brought to their notice, they will have to take cognizance and Act in accordance with law.
Therefore, we are disposing of these two petitions as filed withous there being any cause of action for the same and simple on an apprehension of the petitioners that cos and its progeny would be sacrificed as a religious ritual on the occasion of Bakri-idd.
It will be open for the petitioners to move this court in case they come across such incident and if the same is reported to the authorities and the authorities fail to take any action in the matter. With this observation, the two petitions stand disposed of. All parties concerned are to act on a signed Photostat copy and plain coy of this order on the usual undertaking. Sd/- J.N.PATEL CJ

Essence of ORDER OF SUPREME COURT DT 16-11-94 (P464 of AIR 1995)
“The Act is meant for controlling the slaughter of animals including the cows and buffaloes. State will not have any jurisdiction or power to invoke section 12 for fulfilling such optional religious practice of Muslim community. Even if there is a certificate enabling a person to get concerned animal slaughtered he cannot slaughter it in any place other than the place prescribed in that behalf. Section 7 - whoever contravenes the provision of the Act shall be punishable with imprisonment for a term which may extend to six months or with fine which may extend to one thousand rupees or with both. Section 8 makes the offences cognizable under the Act. Section 9 prescribes punishment for abetment of offences or even attempts to commit any such offence under the Act. In other words there is total ban against slaughtering of healthy cows and other animals. If that ban is to be lifted even for a day, it has to be shown that such lifting of ban is necessary for sub-serving any religious, medicinal or research purpose. As slaughter of cows on Bakri Idd was not an essential religious practice for Muslims, total ban on cow’s slaughter on all days including Bakri Idd day would not be violative of Article 25(1). Mughal Emperor Babar saw the wisdom of prohibiting the slaughter of cows as and by way of religious sacrifice and directed his son Humayun to follow this. Similarly, Emperors Akbar, Jahangir and Ahmad Shah, it is said, prohibited cow slaughter. As per Muslim books, only healthy animals can be sacrificed, but settled legal position, it becomes obvious that if there is no fundamental right of a Muslim to insist on slaughter of healthy cow on Bakri Idd day. It would be equally not open to the State to invoke its exemption power under section 12 for such a non essential religious purpose. “
Cow sale - purchase during Bakri Eid be banned, transportation as well and there are many temporary cow sheds at Bartalla Market beyond Metiabruz Police Station, area of Mitha Talao, Rahmat ka Khatal, "Ibrahim Road", behind Ekbalpur Police Station, "Mansa Tala Lane", around Khidderpur, Mominpur, Ekbalpur, few are controlled and manged by the Govt. agencies.
Watganj, Garden Reach, Metia Buruz and so on, there are thousands of cows are waiting their turn to sacrifice on 17-11-10, hence all these cows should be rescue and rehabilitated in Gaushala's.
PIL No. 381 of 2010 moved in the Supreme Court of India by OIPA in India through its representative Naresh Kadyan and same was fixed for 29-11-2010 at serial No. 29 by the Supreme Court of India but PIL No. 381 of 2010 was deleted for unknown reasons, we are shocked................................

Let some one introduce bill in Parliament and Hon'ble Chief Justice of India may take suo motto. Naresh Kadyan tireless service should be recognized and he may kindly be suitably rewarded, he is the man behind two FIR's against two special cow - cattle trains on 10-12-2000 with GRP, Faridabad and on 28-12-2000 with GRP, Gaziabad.
Subject: An appeal to ensure the complete prohibition upon Cow Slaughter abiding by the existing rules and regulation in force in different states in India along with the strict direction of Hon’ble Supreme Court of India.
Madam/Sir,
Under the laws enforced in this land with a wide view to natural justice to all creatures, honoring the Sanatani tradition of venerated Cow progeny even as non hittable (aghna), respecting the Cow as Go-Mata in highest esteem in the traditional scriptures, contemplating the importance of Cow progeny in Indian agriculture, health, medicines and economics based upon its blessings upon us and obviously to be humane by resisting the animal cruelty, most of the states have been formulated its own rules and acts in favor of banning Cow Slaughter even in Bakri Idd.
But, very unfortunately going to the utter contradiction to the above, in most of the cases Cow progeny are being slaughtered very cruelly in a disgusting gruesome way, sometimes with the help of local administration and politics, only to appease a minority section hurting the majority by violating all the norms so framed by the states very illegally, unreasonably and undemocratically. Though all the Hindu, Sikh, Jain, Buddhists, Arya Samajists and the Sanatani and Vedic followers want a total ban on cow slaughter in Bharat, as a matter of humiliation of all Bharat Dharma, the rampant cow slaughter is going on violating all the norms in force.
As an example, the state of West Bengal, now Paschimbanga had given permission in the last year to slaughter Cows in Bakri Idd under the section 12 of the WB Animal Slaughter Control Act 1950, very intrigue-fully going against the verdicts of Hon’ble Calcutta High Court and the Hon’ble Supreme Court of India.
It is a wide known fact that being aggrieved Sri Kedar Nath Brahmachari and 26 others filed a petition against the State of West Bengal and 20 others for which Hon’ble Calcutta High Court passed an order to ban cow slaughter even in Bakar Idd, vide 1982(2) Kokata, HN dated 20.8.1982.
The State of West Bengal filed an appeal in Supreme Court of India against the above order of Calcutta High Court vide CA 6790/1983 – State of West Bengal & Others. –vs– Ashutosh Lahiri & Others. for which the Hon’ble Supreme Court maintained the order of Calcutta High court to prohibit the Cow slaughter in Bakri Idd as such slaughters being unconstitutional and directed the State to take measures to stop such illegalities.
Despite of that in West Bengal and other States at least 30 lakhs (5 lakhs in West Bengal) healthy, milky, cultivating and capable Cow progeny are slaughtered very unfortunately within a political nexus of Chairman, Sabhapati of Panchayet Samity and the official authorities in various departments.
As aggrieved by the gross violation of the Slaughter Control Act enforced in different States time and again and felt detrimental to the majority Hindu sentiment in general, various forums filled many petitions in the designated Courts for getting justice to stop cruelty upon animal and especially mentionable the petitions filed in the Honb’le Calcutta High Court by Akhil Bharat Krishi Go Seva Sangha, Arya Pratinidhi Sabha, Sri K K Singhania, Sri Abhijit Das & Enamul Haque and others.
It is also mentionable that the esteemed Islamic Institution “Darul-Uloon-Deoband” also declared a Fatwa describing not mandatory to slaughter cows in Bakri Idd and requested not to do such accordingly. The extract of the Fatwa can be obtained from the news published in Dainik Jagran dt. 13.06.2006.
But unfortunately, the chain of illegal slaughter is in vehemently increasing, killing healthy, capable and milking cows, while the children of the poor families are dying do to malnutrition and don’t get a single drop of cow milk in this land of “Gopal”. As per report of the UNICEF entitling “World Children Status Report-2008”, every day 5000 children are dying in India due to malnutrition.
It is well established that the Cow progeny is the foundation of our agriculture, health, conventional & renewable energy source and the all round development of this Sanatani Land with a highest veneration to Go Mata and Go Palak (Cow Savers). And butchering these very calm and pretty animals hitting the religious sentiments of Hindus must attract the provisions of Section 153 and 295 of Indian Penal Court.
Again, a Seven Judges Bench in the Honb’le Supreme Court of India gave the verdict in CA No.4937-4940 of 1998 being the case of State of Gujrat & Others Vs. Mirajapur Moti Kureshi Kasab & Others. [2005/ SCCL.Com-735] propounding the importance of Oxen over the age of sixteen years for their utility in case of agricultural manure and recycling energy production from its dung and urine and consequently prohibited oxen slaughter even over 16 years of age of it.
Cow slaughter is completely prohibited without any discrimination of age or condition inDelhi, Haryana, Punjab, Himachal Pradesh, Jammu & Kashmir, Rajasthan, Madhya Pradesh, Chattishgarh, Bihar, Jharkhand, Uttarakhand, Gujarat etc., but the total prohibition of Holy Cow progeny in the length and breadth of this Holy Land is still awaited within a suitable Constitutional amendment. On the other hand the violation of existing slaughter prohibitory rules and regulations are inciting the Hindu sentiments by some communal elements finding the loop holes of the police and administrations by the way.
In this context, these are our earnest requests to the effect that:
A. Please maintain and give full protection to the Prohibitory Acts on Cow Slaughter on Bakri Idd this year on 7th November, 2011 and to extend full cooperation and security to all forums to restrain these illegal slaughters in their activities to help the police and administration on spot of occurrence of illegal slaughters in every state, especially in West Bengal.
B. Please form a task force in each level comprising Govt. officials and the related NGOs to restrain illegal cow slaughter in every place, especially in West Bengal. Please stop all Cow markets set up for Bakri Idd and ban interstate import-export of cow progeny for slaughter as a mandatory measure.
C. Please apply the provisions of National Security Act (NSA) against the perpetrators for the violation of Animal slaughter Control Acts.
D. Please set a high strategy team for banning all type of Cow progeny slaughter under illegality and to monitor the prohibition and utilization through videography in surface and even through helicopter in the disturbed area due to cow slaughter.
E. Please start legal proceedings against BDO (Block Development Officer) and the Officer-In-Charge of the Police Station of the respective Block and the police station where the cases of illegal cow slaughter may occur violating the existing rules and regulations.
F. Please construct the Cow Rehabilitation Center in each district to maintain the rescued Cows and Oxen from illegal slaughter with a coordination of the various “Gosewa Goraksha Sangathan” (Cow Rehabilitation & Protection Organizations) for a sustainable development of Indian agriculture, health, economy, energy, traditional medicines and ecology.
