Why this petition matters

Started by Michelle Angrimson

Restaurant owners are now passing down the cost of processing credit cards to their EMPLOYEES. For every tip left on a credit card, employers are withholding a percentage of that tip from the server to cover their processing fees. Unfortunately, after much research, I found out this is LEGAL in all but 4 states.

Considering servers in NJ only get paid $2.83/hr on average, I do not think they should be held liable because the business accepts credit cards. Employees do not have a choice whether the establishment they work for accepts credit/debit cards. If a business doesn't want to pay processing fees, they should be cash only. It is unfair to pass those costs to their already underpaid employees.

Something to think about: Server wages

(TIP - 20% BUS - 10% BAR - 4% CREDIT CARD PROCESSING FEE)

$10 - $2 - $1 - .40 = $6.60.

You sat at their table for 2 hours. $2.83 + 2.83 + 6.60 = $12.26 or $6.13/hour
