I Marquis Taylor have alot of family and friends who voted some officials in the public office because they have trusted them to protect and uphold the constitution, but my constitutional rights have been violated in the Judicial System pertaining to my Marijuana offense and my probation violation. The officials of the Judicial System actions were inconsistent with the statue standard of the marijuana offense and the probation violation. It will best serve the voters interest who elected some officials in office if this matter can be looked into and resolved in a reasonable manner. The Circuit court Judge Allen Sharrett should recuse himself from my case so I can file for a motion to vacate in the said court. The public constitutional rights should be protected and upheld and the elected officials should exercise their authority to do so.Basically,I was charged with possession of Marijuana with the intent to distribute. The amount of Marijuana I was charged with was 1.73 ounces and due to my possession of marijuana offense my probation is revoked I was sentenced to serve nine and a half years for possession of marijuana with the intent to distribute and I was sentenced to five years and 9 months for a probation violation. On July 7th,2008 I was presence in Hopewell Va. Circuit Court Judge Allan Sharrett deprived me of a hearing on my Pro Se motion, Pro Se means that I filed the motion myself. I file a motion to suppress evidence due to my 4th Amendment rights being violated my right was violated on the night that I was arrested November 26th 2007 the night I was arrested the arresting officer did not have a search warrant nor did he possessed articulate or objectively reasonable belief that I was potentially or presently dangerous. However Judge Allan Sharrett unlawfully denied a hearing on my Pro Se motion by simply indicating that only my attorney can make trials decisions as to what motions to file and how to handle my case. That decision Judge Allan Sharrett made was totally false because all offenders have a right to make trial decisions as well.Judge Allan Sharrett ruling deprived me of a hearing for my filed Motion to Suppress evidence. Also on July 30th,2008,Judge Allan Sharrett refused to investigate my claim of my attorney Stephen L.Hewlett failing to file applicable motions involving the violation of my amendment right and due process right.And it resulted in a violation of my right to effective assistance of counsel.
