Why this petition matters
Free Hindu Temples from Government control.
Article 14 of the Constitution of India guarantees Right to Equality and discriminations on the basis of race, religion, caste, creed or community.
Article 25 of the Constitution of India guarantees Right of Freedom of Religion. .
Article 26 of the Constitution of India promises freedom to establish religious & charitable institutions and manage with no interference from the Govt.
But it has not repealed the Madras Hindu Religious Endowment Act 1925 which became Hindi Religious and Charitable Endowment Act 1959.
Even Karnataka High Court has struck down the Karnataka Hindu Religious & Edowment Act 1997 as it violated Article 14, 25 and 26 of the Constitution.
Yet unscrupulous politicians usurped the Hindu Temple Funds to provide for Muslim & Christian Institutions.
Only it is mandatory for Hindu temples to contribute 5% of the revenue to Common Pool Fund . In 1997, Karnataka Govt allocated Rs.12.00 crores from Temple funds to Madrasas and Churches.
Andhra Pradesh Govt had appropriated 85% of Tirumala Tirupati Devasthanam (TTD) funds of Rs.3,100 crores.
In the famous Nataraja Swamy Chidamabram Case, the Hon'ble Supreme Court that Govt can appoint an Executive Officer/Administrator when it receives specific complaint of misuse of funds and mismanagement of the temple and that too for a specific period to set right the wrongs and the Executive Officer is to look after the administration allowing the priest to perform their rituals. Hon'ble Supreme Court categorically laid down that the appointment of Executive Officer is to be made for a specific period on co-terminus basis.
Point of argument is that all these Acts controlling Hindu Temples are ultra vires to the freedom guaranteed in the Constitution of India and why Hindu majority of India are subjected to such Govt control, leaving other religious institutions earning crores of rupees every year without any contribution to the Govt.
I appeal to the Hon'ble Prime Minister of India to please repeal all State Laws by bringing Hindu Religious & Charitable Institutions at par with all other religious institutions and free them from the clutches of the Govt who are misusing the Hindu funds for non-Hindu cause.
I am confident that NDA-3 has successfully abrogated Article 370 & 35A to bring back Jammu & Kashmir in the mainstream of India, similarly, the NDA-3 will be able to do justice to Hindus in India facing legal discrimination.
