I am a litigant in Courts in India since past 14 years. I have observed that a lot of oral communication between Court, lawyers, witnesses and parties goes unrecorded and an order is passed as per the judges discretion. This is the gap where malpractice happens. Orders can very adversely affect parties and no one can be held accountable as certain communication verbal as well as gestures and behaviours go unrecorded.
I was arrested and jailed for a week on police's false statement in court for which he had no proof. I kept yelling to court for asking him to show proof which he didn't have and made oral statements which were blatant lies. Court ordered judicial custody for no fault of mine and eventually police gave a report that there's no case.
Implementation of video recording system in all courts will take a long time. Meanwhile a lot of damage can be prevented if parties can shoot videos themselves.This would be a great deterrent for lawyers, parties as well as Courts from committing perjury.
Also, same in police Stations when a person goes to report a complaint or give statements for their complaints. Police behaviour will certainly be under check if this happens.
As these are legal issues with severe consequences strict surveillance is required in order get sound justice.
All litigants would be benefited except the corrupt and dishonest. This move would help resolve cases faster.Transparency will be established. Corruption will automatically reduce. Malpractice amongst Courts, Lawyers and Police will reduce.
Poor and innocent litigants will benefit as they cant bribe even if they are on the right side of law.
