The Department of Education has Sovereign immunity when it comes to it student loan servicer’s mistakes. Student loan servicer’s can escape the law by stating they do not have any interest in the loan, after all they only service them. Therefore, there is no consumer protection when it comes to fraudulent activities. 6 state Attorney Generals are suing Navient, the Department of Educations top servicer, on grounds of deceptive practices, including excessive interest charges, misallocating payments, false credit reporting, and predatory lending. The President cannot turn a blind eye anymore and has appointed Miguel Cardona as the new secretary of education. It is a good start. But we need cancellation of these loans and stop the Department of Education and it servicer’s from profiting off students who have no legal recourse. This petition is to ask President Biden to not only forgive the debt it’s student loan holders did not rack up, but to force the Department of Education to be held accountable, and to investigate its dealings with the servicer’s to understand what part they are playing in keeping them for hire. There is a lack of transparency in every student loan account that is being handled, and we must assert our rights
