This petition is being created to make life easier for those who suffer from Celiac Disease and Gluten Sensitivity.  Since these medical conditions impact almost every aspect of a person’s life it is URGENT that this legislation be implemented as soon as possible.  Once passed it must be required that all affected parties be in total compliance within, but no later than, one year from date of passage, or face penalties for non-compliance. Comprehensive legislation is needed now!

ALL products labeled gluten free should be required to be 100% totally free of gluten – none allowed at all - since even the smallest amounts can cause a serious reaction for many people.  Also ALL products labeled gluten free must be required to be processed in a dedicated gluten free facility only.  To encourage more businesses to produce gluten free products the government can offer tax breaks or subsidies for new gluten free production companies or for existing companies to convert their current processing facilities to be gluten free compliant.  These incentives should also apply to other businesses such as gluten free dedicated restaurants, retail outlets, housing complexes, medical facilities etc.

An easily recognizable universal Gluten Free labeling system needs to be established by the FDA and USDA and be required for all food and drug products that claim to be Gluten Free. 

ALL of the following products should follow the newly created regulations for proper gluten content/gluten free labeling:  food, beverages, liquor/spirits, vitamins and supplements, oral care products, cosmetics, and body care products.

ALL items that contain any form of gluten must be clearly stated as such on all labels in order to eliminate the possibility of “hidden” gluten in products.  ALL products that list any form of starch including but not limited to: modified food starch, pregelatinized starch, sodium starch glycolate, dextrates, dextrins, dextri-maltose, and maltodextrin etc as an ingredient, must be required to list the derivative of that starch (ex – wheat, corn, rice, potato, tapioca, oats, barley etc) on their labels.

ALL prescription pharmaceutical and “over the counter/OTC” medication products must be required by the FDA to be 100%   gluten free.  Very often patients have to refrain from taking much needed medicines while pharmacies or the patients themselves, have to track down drug manufacturers to find out the derivatives of the starch contained in the inactive ingredients of their medicines, causing serious delays and precious, wasted time for both patients and pharmacy employees.  When time is of the utmost importance, locating this info can take hours even days to find out.  Worse yet, it could seriously jeopardize a person’s life if they cannot take their medications immediately when they need them.  If gluten that is present in medications, it can cause severe allergic reactions and/or malabsorption of those medications. 

Gluten-free products are currently significantly more expensive, and can be two times to several hundred times higher in price, than exact or similar items of the same products that contain gluten.  This targets, penalizes, “price gouges” those with gluten allergies/sensitivities.   The CPA/Consumer Protection Agency needs to establish special regulations to prevent this and create a consumer hotline dedicated to report manufacturers or retailers that over price/over charge the consumer for gluten-free products should also be created.  ALL gluten free products should be required to be equivalent to or have a price cap of no more than 10% higher price than equivalent/similar products that contain gluten.

A Federal and/or state gluten free financial assistance/voucher program should be established for those who have been medically diagnosed with Celiac disease or gluten sensitivity to help with the exorbitant costs associated with having to live with these diseases.  In order to qualify for assistance the applicant would be required to have a form signed by their primary or other digestive related physician verifying that they are medically diagnosed with Celiac Disease or with gluten sensitivity.  This is crucial especially for those living on a fixed income.
