I Ashiq Merchant A Citizen of India Request To YouBe My Voice To Save The Truth From Suppression, Which Is Birth Right of Every Living Being on This Earth, I Am Fighting For Justice From 9th February 2017 Against Suppression & Killing of Truth, The Incident Took Place In Open Bombay High Court Room No 20 on 31st August 2016 At 3 p.m, Raise Your Voice Against Oppression Because Today It's Me Tomorrow It May Be You, I Request You To Be My Voice To Save The Truth From Suppression.
The Short Note of Incident: A suit was filed based on bogus documents for a property situated at Mulund, Mumbai. I brought to the notice of the Court about the fraud and filing of bogus documents in Court by Plaintiff. Hence, Justice S. J. Kathawala asked me to file an Affidavit on one subject as it will help the Court to decide the dispute speedily.
So I brought into the notice of Court one Mutation Entry 3005. Then Court directed Talathi to remain present in Court on 31st August 2016. Talathi came with original records and stated before the Court that the Mutation Entry shown to him filed by Plaintiff’s (Manish Bawa) is not genuine. But no statement was recorded by Justice S. J. Kathawala, as the same was proving fraud of Mr. Manish Bawa (Plaintiff). On being repeated request to take the statement of Talathi on record. Justice S. J. Kathawala assured that statement will come in Final order after argument.
Then argument was kept on 20, 21, 22 September 2016 at about 10 a.m. After four and a half months, an order came to be passed on 8th February, 2017without statement of Talathi and suppression of original record.
Possibly the Nature wanted to come to our help us, so we got the C. D. of videos and audios of recording when Talathi had stated to the court from Mr. Gopal Shetye, who himself is victim of false implication and has served full term of 7 years in jail before he was acquitted by High Court, holding that Police framed him”.
I Am Having Faith & Hope, That You I’ll Be My Voice to Save the Truth from Suppression. In State of Orissa and Anr. Vs. Mamata Mohanty, (2011)3SCC 436, it is ruled as under; Once the court comes to the conclusion that a wrong order has been passed, it becomes the solemn duty of the court to rectify the mistake rather than perpetuate the same. To perpetuate an error is no heroism. To rectify it is the compulsion of judicial conscience.
In this, we derive comfort and strength from the wise and inspiring words of Justice Bronson in Pierce v. Delameter, A.M.Y. at page 18: A Judge ought to be wise enough to know that he is fallible and, therefore, ever ready to learn: great and honest enough to discard all mere pride of opinion and follow truth wherever it may lead: and courageous enough to acknowledge his errors.
