Sierra Leone maintains the death penalty in its law books for 4 offences including murder and treason. Most treason trials are political and as Aminata Forna showed in her book 'The Devil that Danced on the Water' they are grossly unfair. Many have been killed unfairly by our courts. There are a plethora of issues and problems affecting the effective dispensation of criminal justice. The capacity of the police is limited to properly investigate case. DNA and forsenic is not available to analyze evidence. Legal representation in capital offense cases especially outside of Freetown is mostly inadequate. Pursuant to Section 121 of the Criminal Procedure Act 1965, every sentence of death shall direct that the person condemned shall be hanged by the neck until he is dead, but shall not state the place of execution. In the case of court martial, execution is by firing squad. Both very inhumane. ILRAJ strongly believes that the time is now ripe for Sierra Leone to abolish the death penalty. It is not a deterrent and violates the sanctity of human life. It is irreversible. Mistakes happen even in the best justice system.
