UPDATE: Although I don't yet know the result of the vote that ended on the 16th, I wanted to thank everyone who supported this petition. We were heard and got the attention we needed to start the conversation. This is not the end of our coordinated effort to make positive change for the mountain, so please stay tuned. Hello Buck Mountain Neighbors,
As you are likely aware, there has been a proposed change to our community covenants that was sent out on or around 11/15/2022 by the Buck Mountain Board of Directors, with votes due by 12/16/2022. The stated reason for the due date of 12/16/2022 is because our current covenants renew on January 1st, 2023.
We agree with the Board of Directors that the covenants require updating, and many of the proposed changes are objectively beneficial for the community. However, there are multiple components of the proposed covenants that proved controversial, which were not able to be voted on as separate amendments. This was demonstrated in a Zoom call on 12/1/22 – in which over 89 members of the community participated; one of the highest turnouts recorded for a board-held meeting.
Our recommendation is to vote on a SINGLE amendment to the community covenants - changing the date on which our covenants renew from January 1st, 2023 to April 1st, 2023. This would allow the Board of Directors the time and opportunity to review community feedback, revise any necessary components that can be voted on as separate amendments, and redistribute a new version of the covenants for the community to vote on that has had more community involvement.
We respectfully ask that the Board call this meeting on 10-day notice, and to be held no later than 12/16/2022; due to the urgent nature of the request.

Article VIII, Paragraph 2. Term
“The Covenants shall affect and run with the land and shall exist and be binding upon all parties and all persons claiming under them until April 1, 2023 (removed January 1, 2023). By accepting a deed to a tract subject to these Covenants, the tract owners agree that after April 1, 2023 (removed January 1, 2023), these Covenants shall be extended automatically for successive periods of ten (10) years each, unless an instrument signed by the members holding more than fifty (50) percent of the voting rights in the Association has been recorded, agreeing to change the covenants in whole or in part; provided, however, that at any time after January 1, 1996, these Covenants may be amended by the vote of two-thirds (2/3) of each Class of members of the association to make variations in the Covenants but not to make changes that would annul any material rights of owners provided
