HB1441 Is unconstitutional. This legislation would require a woman seeking an abortion first to obtain written permission from her sexual partner. It would also require her to provide his name to her doctor and would forestall the procedure if the man wanted the opportunity to challenge paternity. This has chilling consequences for the women's health and well-being and threatens to escalate domestic violence against women. Is the state of Oklahoma stepping up their efforts to assist single mothers? ensure adequate health care for children and protection from abuse? And are they willing to step up efforts to pursue dead beat dads pay for their children?
The U.S. Supreme Court struck down a similar provision ruling spousal consent requirement as unconstitutional. The 1976 decision Planned Parenthood v. Danforth and spousal awareness in the 1992 decision Planned Parenthood v. Casey.
