The Equal Rights Amendment (ERA) has just been ratified by the State of Virginia, making Virginia the 38th state to ratify ERA. In 1972, Congress had voted to place a deadline on ratification of ERA. Article V of the United States Constitution nowhere grants Congress the power to impose deadlines on ratification of any amendment. Congressionally imposed deadlines for ratification are unconstitutional. Article V of the United States Constitution should be followed and the deadline be declared unconstitutional.

The Attorneys General of three states have filed suit against David S. Ferriero, in his capacity as official Archivist, to have the ratification deadline declared unconstitutional, null and void.  This would make the newly ratified ERA our 28th Constitutional Amendment.  We beg of you to follow their suit and do the same.

Bear in mind that the 27th Amendment to the Constitution, the Congressional Pay Amendment, languished for 202 years before gaining the needed 38 states for full ratification (Citation: https://constitutioncenter.org/interactive-constitution/interpretation/amendment-xxvii/interps/165 “The Twenty-Seventh Amendment was accepted as a validly ratified constitutional amendment on May 20, 1992, and no court should ever second-guess that decision.”

If Congressionally imposed time limits are allowed as a de-facto addition to Article V of the Constitution, it could be a dangerous precedent. The amendment process could become a victim of political factions, each vying to put arbitrary time limits on amendments that they do not support.

We, the supporters of this petition, look forward to seeing the following proclaimed:

       The Equal Rights Amendment, which was originally proposed by Congress to  the States for ratification in 1923, and having been ratified by three-fourths of the States, has been ratified pursuant to Article V and is accordingly now part of the Constitution.

       Under 1 U .S.C. §106b, the Archivist was, upon receipt of formal instruments of ratification from the requisite number of States, required to publish the Equal Rights Amendment along with his certificate specifying that the Amendment has become valid, to all intents and purposes, as part of the Constitution.

We, the signees of this petition, entreat and encourage you as Attorney General of the State of Colorado to stand behind the Article V of the Constitution of the United States and file suit against David S. Ferriero to remove the unconstitutional deadline for ERA ratification.
