Petition to disqualify U.S. District Court Judge Aileen Cannon in the case of Donald J. Trump VS United States of America Case No 22-81294-Civ-Cannon

As detailed in NRS 1.230, the grounds for disqualification are laid out as follows:

● A judge shall not act as such in an action or proceeding when they entertain actual bias or prejudice that is for or against one of the parties to the action.

● A judge shall not act as such in an action or proceeding when an implied bias exists in the following ways – when they are a party to or interested in the action or proceeding when they are related to either involved party or related to any involved attorney or counselor, or when they have acted as the attorney or counsel for either of the relevant parties in the action or proceeding in question.

In April, the plaintiff had sought to get a racketeering lawsuit against Hillary Clinton before the Southern District of Florida, where Cannon is a judge. That case went to Clinton-appointee U.S. District Judge Donald Middlebrooks instead, and the plaintiff asked Judge Middlebrooks to recuse himself from the case.

Middlebrooks took notice of Trump’s attempt to get a judge seen as friendly in that case and specifically mentioned Cannon in court documents.

“I note that Plaintiff filed this lawsuit in the Fort Pierce division of this District, where only one federal judge sits: Judge Aileen Cannon, who Plaintiff appointed in 2020,” Middlebrooks wrote. 

Judge Cannon has shown clear bias for the plaintiff through her deferential treatment of the plaintiff. The extreme and one-sided rulings Cannon has made for the plaintiff show a clear bias for the plaintiff through her actions. Judge Cannon's rulings have not only been prejudiced against the defendant but also against the special master that Judge Cannon herself appointed. 

Such actions not only show a bias for the plaintiff but also constitute a real and present danger to the continued welfare of the United States of America.
