Petition to Commute the Death Sentence of Darryl Durr
Darryl Durr did not receive a fair trial, but thus far the state of Ohio plans on killing him on April 20th.
- Ohio Governor
We, the undersigned, are concerned citizens who are petitioning to commute the death sentence of Darryl Durr to life without parole.
Darryl Durr was convicted of the 1988 murder of Angel Vincent and sentenced to death.
There is no physicall evidence connecting Darryl to the murder and he has maintained his innocence.
The key witness was his ex-girlfriend, who has paranoid schizophrenia. Furthermore, other witnesses that contradicted her were not heard at the trial.
Trial counsel was ineffective for failing to:
-Interview members of his family and obtaining a social history.
-Object to portions of the State’s closing argument.
-Object to allegedly improper jury instructions.
-Obtain experts for mitigation.
The trial counsel stated because the court would not cover the costs for a pathologist, criminalist, psychologist, or mitigation specialist, they didn’t attempt to get any sort of expert where a psychologist would have provided the jury with mitigation evidence.
No DNA testing has been done on a necklace found on the victim that could help prove his innocence.
We deeply sympathize with the family and friends Angel Vincent, but we respectfully offer that another death will neither heal nor resolve this tragedy.
