Kevin Williams aka Kirby Stewart is a 50-year-old man from Brookyln, New York. He has spent the past 19 years in the state of Pennsylvania serving a life prison sentence without the possibility of parole, for a crime that took place while he was 167 miles away in Brooklyn, NY.

 This is his story in his own words:

 “On March 11,1999 I was arrested in Brooklyn, NY on a fugitive warrant out of Lancaster Co., Pennsylvania. I fought the extradition and the Commonwealth came with a fraudulent governor's warrant that stated that I fled the jurisdiction to avoid being arrested for the crime of criminal homicide. The Kings Co., Judge Martin Schneider, agreed to extradite me after an extradition hearing on 07-01-99. No charge was ever established, I was charged on a general charge of (2501) which was never mentioned in this case. On March 2000 trial calendar, my trial attorney Mark F. Walmer, convinced me for over two hours to go to trial without a jury. During this trial my wife of 13-yrs passed away.  I was found guilty of first-degree murder, (2502a) a charge never mentioned in the case. I was never formally arraigned on first degree murder charges, I never had a pre-sentence investigation, but I was sentenced to a Life Imprisonment without parole. All of my direct appeals have been denied. I filed my first Post-Conviction Relief Act August of 2001, during an evidentiary hearing I found out about Brady Violations, where the Commonwealth offered its witnesses deals and favors for their dishonest testimonies. So according to law, one has to petition the state’s highest court before you can file a second successful petition. So, when I filed a second petition the Court of Common Pleas said I was time barred, while I was in the appeal process. I took this matter through all branches of court, even filed a Writ of Habeas Corpus in the Eastern District of Pennsylvania. I took my case all the way to the United States Supreme Court on a Writ of Certiorari, because as I've stated the case is based off of Circumstantial Evidence, and Hear Say, the only connection of mines to this case is a "theory" that I know the alleged people who the Commonwealth believe committed the crime.

 

During this time, I have watched my life pass me by. I have lost my wife, I have lost family members, I have lost connection with my children who were young at the commencement of my imprisonment. All the while I hold on to the simple fact that I was not present in the Commonwealth when this crime happened. I am an innocent who is losing precious time. I have studied and fought for my opportunity to receive a second chance to expose my innocence. I don't have the financial means to hire an attorney to continue my fight. I attached a 42 U.S.C.S. 1983 Civil Rights Complaint, arguing negligence on behalf of the Kings Co., District Attorney's Office, because they had me illegally arrested for this crime. Now I need the "truth!" to come out, that I didn't commit this crime, that there is no crime within the State of New York called "Accomplice Liability," there is no Conspiracy charge, and the Commonwealth knows that I was not present when this happened, so I didn't flee the jurisdiction. I am serving a life sentence for a crime I have no connection to  and that I am not guilty of committing.  I continue to fight for a chance at light and to live the life I have been robbed of due to this injustice.”
