THE PROCEDURE IN WORLD LEGAL SYSTEM MUST BE MADE TO REFLECT BALANCE, PROPORTIONALITY AND EQUITY IN THE WORLD CRIMINAL JUSTICE SYSTEM OVER CRIMINAL ACCUSSATIONS THAT FAILS THE BURDEN OF PROVE IN COURT.
This position is supported on the burden of prove in criminal proceedings that save and except that accusations are proved beyond reasonable doubt to warrant a conviction then similar justice, equity, proportionality, balance and fairness should protect that accusation that fails such a burden is to be technically adjudged as beyond unreasonable doubt to be proceeded against the accuser in trial also in order for them to rebut that they are not in fact telling lies.
Justice is to be summed up on the premises that once a criminal accusation is made that one person must be tied to justice on grounds of punishment unlike the present posture where those telling the truth and / or lies are freed together would not be in line with the principle of natural justice itself.
The general presumption over challenge that same will be preventing people from reporting crimes is what is in the contrary prospering illetimacy in the criminal justice system through inventions, hatred, coveteousness, destruction and assisting one party to gain advantage on the fact that they stand to lose nothing also and for which the position should be balanced in the criminal justice system for both the accused and accuser.
This position will be proportionate with the principles of natural justice and the human right of fair hearing which the present position does not guarantee to all accused adjudged not guilty or acquitted.
This position will foster Justice, equity and peace in the world criminal system.
This will stop decriminalization and making of scape goats through frivolous accusations and advantage offered to accusers that stand to lose nothing in balance of similar protection that should be guaranteed to the accused under presumption of innocence also.
