MOTION TO AMEND RULES PERTAINING TO PETS (CATS) IN COMMON AREAS

Current

 

24.1 A proprietor or occupier of a lot must not keep any animal upon the common property after being given notice by the Owners Corporation to remove such animal once the Owners Corporation has resolved that the animal is causing a nuisance.

 

24.2 A proprietor or occupier of a lot must ensure that their visitors/guests do not bring any animal(s) into their lot or on the common property.

 

 24.3 A proprietor or occupier of a lot must ensure that any animal belonging to them does not urinate or defecate on common areas including the garden area. The owner of the animal must remove any defecation from the common areas caused by their animal, using a “poop and scoop” bag.

 

24.4 A proprietor or occupier of a lot must ensure that any animal belonging to them is restrained and on a leash at all times, or carried in a cage, when on common property.

 

 24.5 A proprietor or occupier of a lot must not allow any animals within the fenced amenities and pavilion area (including swimming pool and surrounds, gymnasium, tennis court and spa) at any time.

 

 

 

 

 

PROPOSED AMENDMENTS TO SECTION 24 OF THE OWNER’S CORPORATION ‘HOUSE RULES’

 

 

The following amendments are hereby proposed

 

24.1 A proprietor or occupier of a lot must not keep any animal upon the common property after being given notice by the Owners Corporation to remove such animal once the Owners Corporation has resolved that the animal is causing a nuisance. –Resolution subject to the submission of indisputable evidence by the complainant of the nuisance caused by the animal.

 

24.3 A proprietor or occupier of a lot must ensure that any animal belonging to them does not urinate or defecate on common areas including the garden area. The owner of the animal must remove any defecation from the common areas caused by their animal, using a “poop and scoop” bag. – The owner will be responsible for the removal of any visible defecation by their animal in common garden area.

 

‘24.4 A proprietor or occupier of a lot must ensure that any animal belonging to them is restrained and on a leash at all times, or carried in a cage, when on common property.’ – Excluding cats raised as outdoor cats, whose mental and physical welfare relies heavily on being in the outdoors and who as such; shall be allowed out in common areas, unrestrained and unsupervised between the hours of 6:00AM and 8:00PM daily.

 

24.5 A proprietor or occupier of a lot must not allow any animals within the fenced amenities and pavilion area (including swimming pool and surrounds, gymnasium, tennis court and spa) at any time.  – The animal will be removed from the fenced amenities if owner finds them in these areas. - The accidental and/or incidental breach of this clause does not classify as reasonable grounds for the animal to be considered a 'nuisance' as referred to in 24.1, unless the animal has caused considerable damage to property within the amenities and there is indisputable evidence to demonstrate the animal in question was in fact responsible for any said damages.

 

 

Additional comments & proposed amendments

 

- Animals are to wear collars with names and contact phone numbers on them at all times while on common grounds.
