After hitting a pothole on a California freeway, I reported the incident to CalTrans and documented visually as well as provided evidence of the damage with support from a CalTrans contractor who pulled me off the road. When I received a letter from CalTrans for my claim, it indicated it was denied, but the penal code  noted that the claim was denied under had nothing to do with my claim. I contacted the CalTrans claims adjuster and she indicated that the denial letter uses a general template and my claim was denied based on that there was no previous reported pothole on that road and I was the only one, therefore, I needed to allow for CalTrans enough time to repair the pothole after an incident in order for the claim to be justified. I told her that the pothole is still not repaired and it’s been over a month even though she insisted that a crew went out to do the repair work after I reported it. I also find it very deceptive that they are denying claims based on that there aren’t previous reports as that information isn’t currently immediately available for the public to view. In addition, this petition makes it quite clear that taxpayers are victims of being good citizens. We report incidents, but we will not be able to recoup our loss because we were the ones who reported it. This petition is to hold officials and legislators accountable for allowing for state agencies and regulators such as CalTrans to make this decision and not be held accountable for their misuse of public dollars and resources.
