A serious zoning change is being considered by our City Council.  The owners of 1915 Champlain St., are asking for a zoning change in order to allow a bar and gambling.

WE THE UNDERSIGNED RESIDENTS OF OTTAWA petition the Council to consider public oppositionresidential concerns, and the illegality of the change,  before voting on September 15, 2020.

Public Opposition:  The signers of this petition are opposed to the zoning change.  This opposition is supported by the fact that both the Ottawa Plan Commission AND the City Planner recommended denying the rezoning.

IMPORTANT TO NOTE: The City's attorney advised that granting the zoning change could not be defended in court. Then why would the city council continue with this request?

Residential Concerns:  The proposal is “spot zoning”, the process of singling out a small parcel of land for a use totally different from that of the surrounding area only for the benefit of the owner and to the detriment of the neighborhood.  It is wrong and is a dangerous precedent. 

*Rezoning this property to C3 not only allows it to be used as a bar/gaming parlor, in addition, this precedent would make it possible for businesses such as an auto repair shop, package liquor store, bowling alley, or dog kennel to operate legally as well.  All of which would not require city approval once the property is rezoned to C3.

Champlain Street is an important artery that feeds traffic through the north side of residential Ottawa to our largest park, Lincoln-Douglas Park, and our community cemeteries.  Further congesting an already busy street is dangerous to the children making their way to the park and getting on and off school buses, and dangerous for drivers and residents alike.

Illegality:  1915 Champlain St. has a residence on it but the proposed C3 zoning prohibits the lot from containing a residence.  Also, the legality of the liquor license for the bar is in question because of concerns that the license was not used within 90 days of issuance as required by law.

WE URGE THE CITY COUNCIL TO AVOID THIS ZONING MISTAKE.
