GIVE US BACK OUR WAGE: Sanmina Workers Demand 21 Days Wage Withheld by Sanmina SCI

Sub: Order Sanmina SCI to refund workers their rightful 21 days of wages withheld by it. 

Sanmina SCI pvt ltd, located in Oragadam Chennai, has withheld 21days wages of 400 sanmina workers as a penal action  for protesting against abusive managers. On 14 th March 2017, a worker in the packing section had been abused by the manager who used derogatory and casteist remarks. When the workers demanded that action be taken against him, the management did not respond to our complaints leading to a five day protest. A labour dispute was also raised on 16th March with the labour department. On its request the workers withdrew their protest on 18th March. The labour department had also advised the management against taking penal action against the workers. Yet the company has gone ahead and refused to pay 21 day wage for 400 permanent workers who had protested. 

We, workers of Sanmina SCI plant at Orgadam, Chennai have formed a seperate union 'Sengai Anna mavatta Thozhillalar Sangam'. The company management has  been engaging in various strategies to victimize and threaten us ever since. It is also forcing the workers to become part of the INTUC affiliated union in Sanmina SCI. We have rejected the wage agreement entered between the INTUC union and Sanmina and had also intimated to the management that we are not part of the INTUC led union. Following the incidents in mid march, another manager also abused our worker on 31st March 2017. These actions suggest that they want to provoke to workers so that they can penalize them. The management has also placed a notice threatening summary dismissal against which we have raised a dispute with labour department. They are also acvitely trying to increase the contract labour force. In this situation, they have installed access card system even to monitor our 'bathroom' breaks causing anxiety among workers, especially female workers. They have also given 'Work break' for six days to 142 workers (32 workers between 27/3/2017 and 1/4/2017 and 110 workers between 3/4/2017 and 8/4/2017).  In a latest act of escalation, on 25th July, the company has once again threatened to cut 8 days wage because workers protested a summary suspension of a coworker without giving him even a chance to respond to charges. The protest itself did not last more than half hour. 

We  find these actions of the management, to use derogatory and abusive language at workers, threatening and enforcing wage cuts, compulsory leaves and other actions, to constitute unfair labour practices under the Industrial Disputes Act. We demand that 

A. Our rightful wage that is being withheld be paid to the workers immediately.

B. Free, fair and secret ballot election is held to determining the majority union in the shop floor and management enter into a collective wage agreement with that union

C. Action be taken agains the two managers who used abusive casteist language against workers

D. Stop Victimization of the Workers for establishing a union of their choice by revoking the notice on summary dismissals, ending arbitrary wage cuts and by granting protection for union representatives under 'protected workmen' category of Industrial Disputes Act
