One Dog Bite Law Reversal
Why this petition matters
New York State has a law (The One Dog Bite Law)that says, a dog gets one chance to either, bite, mangle, injure, or even kill someone without the owner being responsible for any damages other than those obtained in small claims court. ie: lost wages, out of pocket expenses, medical bills.
The victim is not allowed to sue for, punitive damages, trauma and/or pain and suffering. Now if the dog again, bites, mangles, injures, or kills someone else, that victim will then be able to prosecute based on the dogs "priors". According to the law a dog gets a slap on the wrist. They get one free chance to reek havoc in someone's life and the victim is just left to suffer.
This law needs to be changed and it's sad that animal rights are more important than human rights. My 3 year sustained injury to the back of her head. Due to a out of control, unleashed, and illegal pitbull, that was not even supposed to be on the property, chased her until she went to the bathroom on herself, charged her/rammed into the side of her into her, her feet were taken from up under her, she was thrown in the air at least 4 feet, and landed on the concrete and she landed so hard that the (hard) plastic ponytail holder, that adorned her hair, was lodged in the back of her head. Making a crescent moon shape as the wound. Where she needed 4 staples in her head. And I was told there is nothing you can do. I was intimidated with the very same dog that caused these injuries, harassed and bullied by the owner and her boyfriend, I was even threatened to be shot, and even shut out of the court proceedings that I initiated. I have been treated so poorly and we are the victims. Left to feel like the aggressors. And all we were doing was playing in the yard on a nice sunny Sunday afternoon.
Please note that the Friday before this incident, i witnessed this same dog chasing some kids across the street and they were screaming for their lives, the owners boyfriend thought it was hilarious, and that alone is what made me call management. Which led to nothing,
This law must be changed.
Please with all I have in me. I beg of you, if you feel this should be changed and agree that all animal owners need to be responsible for their pets actions, especially if they have been negligent. Please sign this petition.
