NYSAR: Urge Gov. Cuomo to Rescind Agents "Essential" Status

The ruling by the Empire State Development agency on 4/1/20 declaring that "The following functions of real estate and/or realtors (sic) are considered essential: residential home and commercial office showings" is flawed and should be rescinded immediately so that all 100,000+ brokers and agents in NY are deemed "non-essential".

Consider the following:

1) This ruling now places every agent in a no-win situation. They must either resume traditional in person showings as requested by clients OR risk losing the client (and the income that could be generated.) For many members, whose business has already suffered mightily, this will be a decision driven more by fear of income loss than by considerations for their own health and that of their families.

2) This ruling may now place every agent at risk of becoming ineligible for any Federal relief offered under the CARES act, or other NY state aid, given that we are no longer prevented from working, yet with the clear majority of clients not wishing to actively engage in the real estate market, we are effectively prevented from actively working regardless.

3) NYS is not yet close to the anticipated peak in CV infections. To now authorize (and likely compel) 100,000+ agents out into the field given the above considerations is not only reckless for agents and their families but also for every buyer and seller and the dozens of people agents must interact with each week in the normal course of doing their business.
