Abolish Medical liability and malpractice reform, known as Senate Bill 33.

North Carolina has a Bill protecting medical professionals from malpractice, there have been many people injured by the healthcare system. Many hard-working individuals, including me, have been severely injured by a medical professional. This Bill called Senete Bill 33 that was First, effective October 1, 2011 (How has this been there this long 10 years of injustice!) the newly elected legislature of North Carolina passed a major tort reform which greatly restricts a malpractice victim's rights when making a claim against a doctor, hospital or nursing home, there will be an image proving the facts from the atterney looking over 2 of my malpractices, and in North Carolina I was neglected at a hospital when I had appendicitis, and had to get 3 opinions of doctors, before they found it. I'm not looking for sympathy, but I worry about the individuals that can't get justice, that are now dead, disabled, or just terrified to go to another health care system. If we don't raise our voices up and call out this malpractice tort reform, it will continue to happen. Here is the Senate Bill 33 restrictions:
1. Limits on non-economic damages in most cases to 500,000.
2. Add additional and heightened requirements that a medical expert on your behalf must attest to prior your filing suit.
3. Raised the burden of proof in the treatment of "emergency medical conditions" to a clear and convincing legal standard.
4. Prohibits juries from being told about the non-economic caps of 500,000.
5. Shortens the time frame to bring a medical malpractice claim when a case involves a minor child or someone who is insane or incompetent.
Here's some statistics: The economic and political climate has become such that the likelyhood of a medical malpractice victim winning a trial are small, In fact, the latest research in North Carolina shows that out of all medical malpractice cases tried in the state, juries find for the plaintiff less then 25% of the time.
