My name is BHASKAR BHATT, Employed in a Private Firm. In early 2013, I booked a 2-bed room flat No –T-5/B-601 in my name along with My Retired father as co-applicant in SUBHKAMNA EPIC Project plot No- GH -02/A, Sector-12, Gautam Budh Nagar, Noida, UP for Rs. 33,74,000/- via registered Firm in the name of Government and Public sector Employees welfare Housing Organisation (GAPSEWHO) ref no. GAPSE/11011/T-5/B-601/2013). Address 202, Vishal Chambers, Sector-18, Noida 201301, U.P.

The company launched its project as “SUBHKAMNA EPIC” Subhkamna Buildwell & Estate Pvt Ltd having its corporate office at A-80, Sector-2, Noida (UP) (later shifted to A-102, Star House, Sector-4, Goutam Budh Nagar, Noida (UP) and Administrative Office at 202 Vishal Chambers, Sector-18, Goutam Budh Nagar, Noida (UP).  

The total value of the said flat was Rs. 33,74,000/- including covered car parking.  We paid the amount of Rs. 3,37,400/- on the date of booking i.e. 30.01.2013 through Citi Bank Cheque bearing No. 031313. And further paid Rs.3,37,400/- 27.02.2013 through Citi Bank Cheque bearing No. 693491 as per the Schedule payment and demand of the Builder. The total payment till the date INR 6,74,800/- (Rs. Six Lakhs Seventy-Four Thousand Eight Hundred only).

After receiving the payment, the Builder issued Provisional Allotment Letter along with covering letter confirming the booking of the flat bearing no. T-5/B-601, dated 04.02.2013.

Despite receipt of the initial payment the project which includes the flat is at very nascent stage and the delay in the progress of the project is totally attributable to the Builder who had not made any efforts to proceed further with the project and when questioned, even threatened us with the team of Body Guards.

Being aggrieved with the gross delay in the project, we wrote a letter dated 3rd May 2014 to the Builder for refund of the deposited amount along with interest as per the Agreement. However, the said refund has not been provided till date (May2019). And neither there is any progress in the project or any contact made by Builder to the buyers!

Neither the builder has given possession of flat until now nor the Refund. We have approached the consumer court along with others and filed the case for refund of total amount including interest from the Subhkamna Builder. 

Fact is that even after 6 years, the construction work on the said project site is at a standstill and even the basic construction work at the site has not been done.

Due to delay caused by Builder in handing over the possession of the flat within agreed period we have suffered a huge financial loss, mental agony and trauma as we had invested our hard-earned money in to the said project. Due to the illegal act of the Builder the we buyers have suffered huge financial loss.

I therefore request that This should be investigated, and appropriate criminal action should be taken against the Builders And also, help get refund my hard-earned money invested in the project. Names of builder’s company owners are 1. Piyush Tiwari 2. Vipul Gupta.

Delhi police EOW has already arrested Diwakar Sharma who was our first builder and now he transferred project on above two builder's names.

Sir please find out their whereabouts by seeking help from Noida authority and company of registrar.

There are more than 300 Buyers affected by this Shame which is showered on to all of us due to utmost negligence from the Builder, From Authorities for not taking any action on this and the Law governing bodies with no Strict and fast governance in place to sort this for all.
