No US Aid to Malawi. Malawi Violates Millennium Challenge Corporation's "Ruling Justly" Requirement.

Malawi is in direct violation of the Millennium Challenge Corporation's guidelines for "Ruling Justly" and should not receive US government infrastructure grants until Steven Monjeza and Tiwonge Chimbalanga and all other LGBTI prisoners of conscience are unconditionally released and there is a full constitutional review of Malawi's laws criminalizing homosexuality.

Malawi is in direct violation of the Millennium Challenge Corporation's guidelines for "Ruling Justly" and should not receive US government infrastructure grants until Steven Monjeza and Tiwonge Chimbalanga and all other LGBTI prisoners of conscience are unconditionally released and there is a full constitutional review of Malawi's laws criminalizing homosexuality.

Steven Monjeza and Tiwonge Chimbalanga were arrested by police in Malawi for having a ‘traditional engagement ceremony' in Blantyre's Chirimba township on December 26, 2009. They have been in jail ever since. Since their arrest Malawi has conducted a systematic search and arrest of lesbian, gay, bisexual, transgender and intersex (LGBTI) people in an attempt to purge the country of homosexuality.

According to Amnesty International and hundreds of other human rights organizations, Malawi's laws criminalizing homosexuality and gender identity criminalize the legitimate exercise of the human rights to freedom of conscience, expression and privacy, and these rights are protected in treaties ratified by Malawi, including the International Covenant on Civil and Political Rights and the African Charter on Human and Peoples' Rights.

Under these treaties, Malawi has a legal obligation to respect and protect the right to freedom of conscience, freedom of expression and the right to privacy, without discrimination on the grounds of, inter alia, sexual orientation.
