The "25 Mile Rule" will be triggered by the opening of medical marijuana dispensaries in Arizona. This portion of the law states someone within 25 miles of a medical marijuana dispensary cannot cultivate their own medical marijuana or use a caregiver to do so, even though that caregiver may be located 25 miles or more from a dispensary.
This portion of the law is inconsistent with the Federal Equal Protection Act. States cannot enact laws that offer protection from prosecution to one group of individuals, those patients 25 miles or more from a dispensary, while not offering the same protection to those patients and caregivers that are located within 25 miles of a medical marijuana dispensary.
This portion of the Arizona Medical Marijuana Act should be removed so that every patient has a choice in how and by whom their medication is produced.
No organization or group of organizations, corporation or group of corporations should have a monopoly over a naturally cultivated medication for purposes of economic gains.
Remove the "25 Mile Rule".
