On Monday 2nd March 2020, the Cross River State (CRS) House of Assembly in a voice vote rejected the confirmation of Justice Akon Ikpeme as substantive Chief Judge of CRS on the grounds that she is from Akwa Ibom State, and represents a security risk to CRS.

On Tuesday 3rd March 2020, Governor Ben Ayade swore in a new acting Chief Judge of CRS - Justice Maurice Eneji.

While the CRS House of Assembly is vested with the power to confirm a nominee for appointment as Chief Judge, we believe such power must be exercised responsibly and on legally sound considerations. The legislature cannot reject a nominee on trumped up charges.

Justice Akon Ikpeme has served in the CRS Government for about 40 years. It is unconstitutional to declare her a non-indigene where she has lived and worked for almost her entire life.

There is also no evidence that she represents a security risk in the State. The CRS House of Assembly, in our view, has therefore acted unjustly in rejecting her confirmation.

We join the Nigerian Bar Association (NBA), the International Federation of Female Lawyers (FIDA) and others to call on the NJC to condemn and nullify the appointment of Justice Maurice Eneji as Acting Chief Judge of Cross River State.
