Proposal for Better Protection for child victims of sexual abuse.

Currently in NYS there is no law to stop predators that are serving sentence from obtaining pictures of children and their victims while in prison. Unless it is specified in a restraining order that a convicted sex offender can’t have photographs, they can. Who would have thought this would be something a victim’s family would even have to worry about, once their attacker was convicted? It should be a given that photos would not be allowed given the nature of the crime, and the sentence that follows.

My granddaughter was a victim of sexual abuse at the hands of her father. It had occurred over an extended period of time, and January of 2015, she finally was able to tell us what had happened. We spent 8 long months in and out of family and criminal court and in August 2015 he was sentenced to 10 years in state prison. Upon investigation, it was confirmed by the correctional facility that he indeed had pictures of his daughter, which in this case was his victim. Someone had mailed him pictures, and we still don’t know who and I was told nothing could be done to stop anyone from sending him any. This is so wrong!

No convicted criminal of any sex crime, especially against a child should be allowed pictures of them, or any child for that matter. He is still abusing her behind bars! He is still able to look at her and see her. While I understand that our prisons are overcrowded and although the mail is checked, and the workers don’t know what crimes the prisoners are in there for, there needs to be a better system in place. There HAS to be a way to stop this!

I spoke with the Superintendent of the prison. Sex offenders are in a different unit and that mail gets looked at by different people. That being said, if that is the case then they can be told about that particular section and should be to confiscate any pictures sent to the prisoners. I also think their needs to be penalties for those that send them. Nothing is impossible! There has to be a way to protect the innocent! The effects of this type of trauma last a lifetime. We see it every day. We see the pain and heartache our granddaughter goes through, as she is trying to deal with and survive this nightmare and the fact that someone she trusted took her childhood and made her grow up to fast.

I would like to propose a law to stop these criminals from being allowed to obtain and have photos based on the nature on the crime. Kaelynn’s Law to Protect the Innocent. I am asking for your support on this. We need to be advocates for these children! We need to stop the abusers from still being able to abuse!
