My sister, Gillian Gibbons was brutally stabbed to death in the Oneonta NY parking garage on the day of Tuesday September 12, 1989. At the most, every 24 months, myself and my family have to go in front of the parole board in Albany NY to fight the parole/release of David Dart, DIN# 91B0463. We have to relive the pain and our devastating loss to ONE parole board member and a stenographer. We don’t get to go face to face with the parole members who sit and see and listen to the cold blooded murder. They can’t see or feel our pain, our tears or our loss. Last parole hearing, this deranged man was given only 19 months! The sentencing Judge wanted him to serve LIFE! Unfortunately, NYS feels that 25 years for a life is sufficient. My baby sister was only 18 years old! He is a rapist, he was sent away for the attempted rape with a knife of a young girl when he was 15! He was sent away until he was 18. We recently were given the option of listening to a letter he wrote us. It was an ‘I’m sorry’ letter. It took him over 30 years to decide he was sorry for us. Prior to this his sorrow was only for his family. In this letter, he stated that he was planning on ‘robbing her’! This is the FIRST TIME since the day he stabbed her 24 times, he has EVER mentioned robbery! If you read the parole transcripts, he was there to MURDER! Murder whoever came along. Unfortunately, he succeeded. I found my baby sister in her car. She was dead, cold and bloody. She had been all alone since approximately 1:00 pm. I found her in the early morning of September 13, 1989. My mother drove by her dead daughters car twice that day. He WILL offend again! He offended as a young child, chasing classmates with knives. He raped a young teenager whose mother blamed it on her, stating she didn’t fight hard enough! He tried again, but Jenny got away. Her parents fought back with her and for her! That’s why he got sent away. She is also one of the reasons I continue to fight! She still has nightmares and flashbacks, as do I. What kind of State do we live in? Why does he get a second chance? Gillian will never get one! NYS should be ashamed of its punishment for murder! James Seward has been fighting for YEARS to get a bill passed to increase the amount of time the parole board can give an inmate instead of only 24 months! How would you Senator’s and Assemblyman feel if this happened to YOUR daughter, wife, niece or your neighbors young woman?!? 25 years is a JOKE and embarrassing for New Yorkers! You need to look at the punishments and make darn sure they fit the crime! I know it’s unjust as does my family, friends, Gillian’s friends and people who never met her and never will but love her still! I have friends who have lost loved ones the same way! One family, after 10 plus years, decided to write a letter instead of attending a face to face parole hearing. They had a family celebration to attend. The murderer was released! I’m begging you to wake up and look around you. Look at your family, your nieces, your granddaughters and hope and pray that David Dart doesn’t end up in your community. I’m begging you all to write the parole board and OPPOSE his parole! ASSEMBLYMAN, PASS SENATOR SEWARD’S BILL to increase the time the parole board can give to an inmate! PLEASE, I’m begging you to INCREASE the penalty for MURDER! This was no accident. “If it wasn’t Jill, it would have been someone else”. I put those in quotes because those were the words of my sisters killer. As he was sentenced, he got up, turned toward me and mouthed “I’LL BE BACK”. Please, don’t let those words come true!
