We ask the Bureau of Early Intervention to request to ALL New York counties that Early Intervention in-home or "face to face" services can RESUME in accordance to with CDC guidelines and NYS Department of Health Guidelines during the on-going COVID 19 State of Emergency per family wishes and provider availability. 

According to BEI's guidance at the beginning of the COVID 19 State of Emergency, our services were deemed essential. We feel we continue to provide essential services. In addition, Occupational Therapy and Physical Therapy services have been deemed essential services (outside of early intervention) and continued to be determined as essential. 

Since we believe we are essential, we are asking you to provide BEI oversight to the counties who are contradicting the BEI and State's guidance on essential services. Counties have been inconsistently deciding when face to face services can resumed based on the NY Forward opening. Some counties believe face to face can resume Phase 2 under professional services, Some counties believe Phase 4 due to the categorization of education, and some counties have continued to allow providers to conduct in-home services throughout the COVID 19 Emergency per family wishes provider availability. 

While we are THANKFUL for the allowance of teletherapy, it has its limitations, including family access to teletherapy and quality of service that is needed in order to meet the family and child's developmental needs. Every day, families are asking providers when can we begin in home services again. 

We ask at this time, teletherapy still be continued to be offered to families which help support the state's efforts to reduce the spread of COVID-19. We ask that with family and provider discretion, that as an ESSENTIAL SERVICE, we can make an individual case by case determination (which is consistent with BEI guidance) across ALL counties of the state. We will implement Health and Safety guidelines that are consistent with CDC, NYS DOH, and BEI guidaince for in-home/face to face services. These are critical services that are needed to these children. Many have regressed during this difficult time. 

It is unacceptable to New York families that some families can access face to face services in one county, but another individual county is restricting the access of a face to face ESSENTIAL services from a State Regulated Program. 

Ultimately, it should be a HYBRID Model of service provision, which takes into the account the necessity of the face to face visit, the family's wishes, the provider's availability and comfort, and the clinical necessity of providing face to face skilled therapy. 

As of today, June 2,2020 per Governor Cuomo's daily briefings, we as the state have flatten our curve and have reduced the spread of COVID 19. We have supported the State's Public Health Efforts by implementing teletherapy. Now it is time to SUPPORT our New York Families and our New York Early Intervention Providers.
