The City of New York NYCERS system has failed to promulgate the 25 of years of service and 50 years of age early retirement option for Tier 4 members that are working in physically taxing titles pursuant to the NYC Administrative Code 13-162. This law has been in affect since 1940. This will allow the physically taxing title pension members to enjoy an early retirement full pension benefit. There was a recent article in the Cheif news paper stating a case in the New York State Supreme Court in Manhattan set a precendent, by overturning a NYCERS decision that denied a New York City Housing Authority Carpenter helper a full pension under the physically taxing provision. This change will revise pension members benefits who are working and who took early retirements that was put in a pension, to work until they are 62 years of age.
