Gum Springs DOES NOT SUPPORT Special Exception (SE) 2017-MV-012 application to permit a private school of special education for a tae kwon do school and a waiver of minimum lot size for Tax Map No. 102-1 79A & 79B as submitted by American Tukong LLC and JNI LLC.

The proposed development is a part of the Gum Springs community and within its conservation plan. The community met with the owner and applicant on March 8, 2016. Afterwards, the community voted to NOT SUPPORT a rezoning of residential property to commercial use because such use is not in harmony with the Gum Springs community or its conservation plan. The applicant decided to move forward with the proposed development by filing an application as a school for special education.  It is not a school for special education!  It's a martial arts school. 

The owner and applicant met with the Gum Springs community again on September 12, 2017.  The Gum Springs community reaffirmed its NOT TO SUPPORT position to the owner and applicant.

The public hearing before the Fairfax County Planning Commission is scheduled for January 18, 2018 at 8:15 p.m.  The Fairfax County Board of Supervisors will hear the applicant on February 6, 2018 at 4:00 p.m.  The Fairfax County Staff Report will not be available to the public until January 3, 2018, which may be insufficient time for the community to review staff comments particularly since its community meeting is scheduled for January 9, 2018.

We, the undersigned, being residents and friends of Gum Springs, request that the Fairfax County Planning Commission and Fairfax County Board of Supervisors DISAPPROVE SE 2017-MV-012 because:
1. The proposed development is not in harmony with the Gum Springs community to include its Conservation Plan and Neighborhood Improvement Plan. The community objective continues to be to encourage developers of vacant land within the community to include moderately-priced housing units;
2. A rezoning of residential property to commercial is required. The Gum Springs community does not support a rezoning of residential property to commercial because such action would not accomplish the aforementioned community objective;
3. A waiver of the C-8 lot size is required. The Gum Springs community is not supporting any waivers for the proposed development in order to protect the residential character of the neighborhood and prevent commercial encroachment; and
4. Access to the proposed development is restricted traveling SB on Richmond Highway—no left turn will be allowed into the property. This restricted access will result in cut-through traffic and pedestrian safety within the Village at Gum Springs.
