Amend the regulatory language of the Endangered Species Act to include captive whales (Lolita) from the Southern Resident Killer whale Distinct Population Segment.

Lolita is a female killer whale captured from the Southern Resident population in 1970 who currently resides at the Miami Seaquarium in Miami, Florida.  The current regulatory language excludes Lolita, the sole member of the Southern Resident killer whale DPS held in captivity, from the endangered species listing.  Despite being a Southern Resident orca, Lolita has been denied the protections of the Endangered Species Act.
