PETITION FOR THE VOTE OF NO CONFIDENCE IN THE CHAIRMAN AND COMMITTEE OF THE HINDU COUNCIL OF KENYA

I, N. GALOT, a Hindu, on behalf of the members of the various communities which make up the HINDU COUNCIL OF KENYA, living both in Kenya and abroad, have composed this petition to express our dissatisfaction with the current Chairman, the Trustees, committee members and ordinary members who make up the HINDU COUNCIL OF KENYA.

This petition is an expression of our “Vote of No Confidence” in Mr. Nitin Malde (and his entire committee) and his ability to lead our communities. We understand the severity of this decision and did not arrive at it hastily.     

The Hindu Council of Kenya has always been a society to be proud of, one of where decisions were made on a collaborative basis with the best interest of our members in mind.  The Hindu Council of Kenya had always been a society that experienced great vision from our leaders, and its members were given the respect and support to hold our heads high in respect and pride.

Throughout the past few years we have had concerns regarding Mr. Nitin Malde's leadership specifically regarding trust, honesty, collaboration, decision making, vision and his total lack of respect for name, image and reputation of the members of the Hindu community. 

Mr. Nitin Malde and his committee members have brought dishonour and disrepute to The Hindu Council of Kenya by; 

-Condoning Child Abuse.

-Supporting child abusers.

-Encouraging and promoting child abuse.

-Threatening and intimidating members of the various communities for speaking up against Child Abuse.

-Using The Hindu Council of Kenya's reputation and influence to negatively influence the laws of the land.

We also believe that Mr. Nitin Malde and his committee members have failed to abide by the constitution of the Hindu Council of Kenya. They are guilty of breaking the following laws as stated in the Hindu Council of Kenya Constitution:

Paragraph 3: OBJECTS:

clause 'o' which states:

TO MAKE REPRESENTATIONS TO THE APPROPRIATE AUTHORITIES ON ANY MATTER AFFECTING THE WELL-BEING AND INTERESTS OF THE HINDU COMMUNITY.

The Chairman and his committee have committed the crime of obstruction of justice, and aiding and abetting of a crime by threatening the Headmistress of My School Montessori if she were to report the child abuse matter to the police or children department, thereby endangering the life of the minor.

Under the same clause, the Chairman and his committee, using the reputation and goodwill of the HCK, falsely and illegally imprisoned and intimidated a member of the Hindu community for raising his concern on child abuse, thereby causing tremendous pain and suffering to both the victim and his family. 

Under the same clause, The Chairman with the approval of his committee has sworn defective statements full of lies and deceit to delay or deny justice to a victim of child abuse. 

Under the same clause, The Chairman and his committee are guilty of perjury under the laws of the land.

Paragraph 8: EXPULSION FROM OR CESSATION OF MEMBERSHIP.

Clause 'b' which states:

A MEMBER MAY BE EXPELLED FROM THE COUNCIL IF IN THE OPINION OF THE MANAGING COMMITTEE, SUCH MEMBER HAS EXHIBITED GROSS DISREGARD OF ANY DECISION OF THE COUNCIL OR THE ACTIVITIES OF SUCH MEMBER ARE, IN THE OPINION OF THE MANAGING COMMITTEE, PREJUDICIAL AND/OR DETRIMENTAL TO THE INTERESTS AND WELLBEING OF THE COUNCIL.

The Chairman and his committee have disregarded this law by EXHIBITING GROSS DISREGARD to the laws of the land, and acting in ways that are PREJUDICIAL and DETRIMENTAL to the interests and well-being of the Council.

Further to clause c of paragraph 8:

SUSPENSION which states:

THE MANAGING COMMITTEE OF THE COUNCIL MAY, IF IT THINKS FIT, SUSPEND OR EXPEL A MEMBER OR ITS REPRESENTATIVE/S FOR SUCH PERIOD AS IT THINKS PROPER, IF THE CONDUCT OF SUCH A MEMBER OR ITS REPRESENTATIVES IS LIKELY TO CAUSE ANY CONFLICT OR EMBARRASSMENT TO THE WELFARE OF THE COUNCIL.

In contrary to this law, The Chairman and his committee have caused great embarrassment to the various communities of the HCK. 

Paragraph 9: OFFICE BEARERS

Clause 'e' which states:

NO PERSON SHALL ORDINARILY HOLD OFFICE OF THE NATIONAL CHAIRMAN CONTINUOUSLY FOR MORE THAN TWO CONSECUTIVE YEARS BUT SAVE AND EXCEPT WHEN THE ANNUAL GENERAL MEETING DECIDES TO EXTEND THE TERM TO ANOTHER ONE YEAR BY THREE FOURTHS MAJORITY VOTES OF THE MEMBERS PRESENT AT THE MEETING.

In contrary to the stated law, The Chairman and his committee are guilty of breaking the constitution by voting in the Chairman for a fourth term. 

The members of the Various communities which make up the HINDU COUNCIL OF KENYA therefore demand the immediate desolation of the current committee and all of its members. 

It is the responsibility of all elected members of the various communities to adhere to the laws of the land and maintain dignity, honesty, transparency and ethics in handling issues for the HCK.

Communities succeed best when its elected leaders maintain a strong partnership with the ordinary members.

The current committee has not created a safer environment, but instead has created a toxic environment for its members. Without the recognition of mistakes or the willingness to listen to its ordinary members there is no hope for rectifying past mistakes or improvement and thus no way forward.

 We feel the Chairman and his committee's failure to recognise and respect the will of the ordinary members will result in the disrepute and downfall of HCK.

 A society or council cannot be run successful with a one-way avenue of communication.  Even when input is sought, there is a failure to follow through or a total disregard for the ideas of many; when communication occurs, it is too often delayed and incomplete. There's just an overall feeling of we as ordinary members are losing ground all the time. We need a different, more solid leadership. The moral is just too low and feel it is time for a change.

 For these reasons stated, we, members of various communities which makes up the HINDU COUNCIL OF KENYA are voting “No Confidence” in Mr. Nitin Malde and his entire committee. We demand the mass resignations of these incompetent people so as to pave way for an independent and transparent election.
