In a landmark ruling in the 1893 case of Nix v. Hedden, the Supreme Court of the United States (SCOTUS) unanimously affirmed that a tomato is a vegetable.  Since then, the government of the United States of America has consistently held this position.

FACT:  The “Dietary Guidelines for Americans," produced jointly by The U.S. Department of Agriculture (USDA) and the U.S. Department of Health and Human Services (HHS), include the tomato among the “Red and Orange Vegetables” subgroup.

FACT:  The Behavioral Risk Factor Surveillance System (BRFSS) is a telephone survey conducted by another HHS agency, the Centers for Disease Control and Prevention (CDC).  The official questionnaire includes the following:

“Not counting what you just told me about, during the past month, about how many times per day, week, or month did you eat OTHER vegetables? Examples of other vegetables include tomatoes, tomato juice…”

FACT:  The U.S. Food & Drug Administration (FDA) requires that labels on packaged food products in interstate commerce not be false or misleading in any way.  That same agency allows V8® Original to bear the phrase “100% Vegetable Juice” even though the most prominent ingredient is tomatoes.

Yet, there is an overwhelming consensus in the scientific community that a tomato is a fruit  — a berry to be exact.  Polling data suggests that a growing majority of Americans consider the tomato a fruit.  For far too long federal officials have ignored these calls. 

How has an elected government of the people, for the people, and by the people been allowed mislead its citizens for well over a century?  The answer is simple:  We let them.

Make the tomato a fruit again!
