Stop Erection of Puja Mandaps, Stages etc. on Roads and Footpaths

During the past couple of years it has been observed that Puja Mandaps, Temporary Booths, Stages, Hoardings, etc. are allowed to be erected on roads, foot-paths and public walk-ways during the festival season in Lokhandwala Township and the adjoining areas, causing immense hardships to the Lokhandwala Township citizens.
Such structures have in the past, stifled the flow of traffic and movement of pedestrians on the only road entrance to the Township and within, causing severe traffic jams for hours. This has not only choked up the traffic but also caused immense delays in Ambulance and Fire-Fighting Vehicle movements endangering the lives of helpless citizens.
Whereas Hon.’ble Mumbai High Court through its Order in PIL No. 173 of 2010 dated 13.03.2015 and subsequent Orders in the matter, has categorically affirmed the right of citizens to pass through a road, it has also denied the Municipal Commissioner and the Police Commissioner to grant permission to allow erection of such mandaps, temporary booths, etc. where they are likely to obstruct free flow of vehicular traffic, movement of pedestrians, are likely to cause major traffic congestion, on a very busy public street having a large vehicular traffic, near bus stands, rickshaw or taxi stands, etc.
In silent disregard to the Hon.’ble High Court’s aforementioned Order, permissions have been given in the previous years for erection of such structures in Lokhandwala Township causing immense hardships and agony to the local citizens.
In view thereof, may we humbly request your good self to deny permission for erection of any such structure on roads, foot-paths and public walk-ways and even on areas adjacent to the roads, foot-paths and walkways, lest they get encroached as always, and allow the helpless citizens to have a dignified life, a fundamental right, as guaranteed under Article 21 of the Constitution of India.
