I am deeply concerned about the reports of Pakistani government restricting the freedom of movement of a prominent and front line human right defender Mr. Jamil Maqsood. Mr. Jamil is serving as the Central Secretary of the United Kashmir People’s National Party (UKPNP) and has been championing the cause of Kashmir freedom for decades, his contributions have been recognized the world over and he is deemed as an authority on matters related to Kashmir. He has been representing voices of dissent, civil society and political activists at the United Nations Human Rights Council since March -2010 and other EU, institutions

Mr. Jamil who holds Pakistani passport is now barred from traveling by the Pakistani state for his stance on Kashmir issue. The act is a direct and blatant infringement of is right as enshrined in the constitution of Pakistan under article 15 that provides that Every citizen shall have the right to remain in, and, subject, to any reasonable restriction imposed by law in the public interest, enter and move freely throughout Pakistan and to reside and settle in any part thereof.

Moreover under article 12(4) of ICCPR that Pakistan is a signatory to provide that No one shall be arbitrarily deprived of the right to enter his own country. It is pertinent to mention here that the international ruling on the said provision states that "there are few, if any, circumstances in which deprivation of the right to enter one's own country could be reasonable.

Mr. Jamil had submitted his passport bearing number AK0313541 at Pakistani embassy Brussels for renewal but instead his passport was barred on 30th of October-2017, even though Mr. Jamil has submitted all the requisite documents and renewal fee. The embassy has failed to respond to Mr. Jamil’s repeated queries pertaining to the status of his passport. Despite repeated efforts to contact the embassy no response was forthcoming from the authorities or any concerned officer.

On 9th of January -2019, Mr. Jamil receives an email from the embassy stating that his passport shall be renewed within fifteen (15), working days. Thereafter Mr. Jamil received no response neither did he receive his passport back.

As recourse Mr. Jamil raised the issue of the apathy of state at the 40th session of the United Nations Human Rights council on 12th March 2019, under the title of Human Rights Situation that Require Council Attention under Item agenda -4. The international community has an impression that the government of Pakistan is using such restrictions to press Mr. Jamil’s peaceful voices and respect and restoration of fundamental human rights in Pakistan and Pakistani administered Kashmir and Gilgit-Baltistan.

The state is imposing illegal and ultra vires restriction to punish and restrain Mr. Jamil from continuing to raise his voice against the atrocities of the government of Pakistan in the region.  

Mr. Jamil has been unable to visit his family members in Azad Kashmir under Pakistani administration for the past several years. The Pakistani government has no right to debar a law abiding citizen to return to his homeland, there exist no moral or legal ground for such an action thus such arbitrary moves are illegal and unconstitutional.

I would like to request the International Human Rights Council to take stern action on violation of human rights by the state of Pakistan. We urge the Pakistani authority to immediately return Mr. Jamil’s passport and lift restriction on his freedom of movement.
