In the registration for GST by small professionals like Consulting Engineers, Software developers whose annual turnover is less than the threshold limit (Rs.9 lacs), two categories are given in the GST rules. These are:
1. Inter-state supply of Goods/Service
Persons making inter-sate supply, irrespective of any threshold limit ( Rs. 9 lacs)
have to register for GST. The person will have to get registered separately for each of the States where he has a business operation and is liable to pay GST.
The GST filing could be monthly or quarterly returns, and an annual return must be filed by all persons by 31st December following the end of the financial year.
2. Intra-state (within the State) supply
Persons making Intra-state supply up to Rs.9 lacs need not register for GST. But those making supply of more than Rs.9 lacs will have to register for GST.
As of now, most of the small professionals with an annual turnover of less than Rs.9 lacs, do Inter-state supply of their goods/services without paying any Service Tax. By the new GST rule, the same professionals are now asked to register with every state they supply of Goods/Services, although their annul turnover is less than Rs. 9 lacs, and file returns. This new ruling is too harsh on the small professionals as they work under a small outlay of office with less facilities for submission of documents to the Government.
It is requested that the rule on Inter-state supply of Goods/Services should replace the present wordings "Persons making inter-sate supply, irrespective of any threshold limit ( Rs. 9 lacs) have to register for GST." by the new wordings "Persons making Inter-state supply up to Rs.9 lacs need not register for GST".
