We are very concern over the issue of traffic safety and excess Noise from speeding and illegal "cutout" muffler systems on Scottsdale Road, 71st Street, Hayden Road and in the general Scottsdale area. The most affected area is in the intersection of Kieralnd Commons and Scottsdale Quarter. The amount of accidents and Noise is disturbing at all times, even late at night the peace of all residents in the surrounding area.
In the last two years there have been several accidents on the intersection of North Scottsdale and Hayden. We fear it is only a matter of time until there is a pedestrian casualty and with so many new condominiums built around the area, the problem and risks will only intensify.
The loud and illegal cutout exhaust systems which seem to encourage racing and speeding are also extremely disturbing for residents living in the area. But most important the Noise is against State, County and City laws as will be listed below...
Respectfully therefore, we petition the Scottsdale City Council, who are responsible for safety and noise levels on Scottsdale Road to implement at least some of the requests listed for the safety and peace of our community:
-More police traffic patrols, especially on weekend nights and in the morning rush hour
-Designation of the area as a fines doubled "Quiet Zone"
-A Reduced the speed limit from Paradise Road to Thunderbird road (heavy pedestrian area at Kieralnd Commons and Scottsdale Quarter, with lots of children, elderly, residents and international visitors)
-Photo Speed Radar
-Decibel Radar Readers

IV. Noise
A. Motor Vehicles
1. It is unlawful for any person to operate any motor vehicle that is not equipped with a buffer in good working order and in constant operation to prevent EXCESSIVE NOISE.
2. It is unlawful for any person to operate a motor vehicle equipped with a cut-out, by-pass, or similar muffler elimination unit, or to operate a motor vehicle with devices that AMPLIFY MOTOR NOISE or motor EXHAUST NOISE.
3. It is unlawful for any person to operate a motor vehicle in such a manner as to cause or allow to be emitted squealing, screeching, or other such sound from the tires in contact with the ground because of rapid acceleration, excessive speed, or other reasons. Sounds resulting from emergency deceleration braking to avoid danger shall be exempt from his section.
4. It is unlawful for any person to cause the excessive revving of any motor vehicle engine while such vehicle is not in motion, except when done during the repair or testing of such vehicle between the hours of 7:00 am and 8:00 pm.
C. Radios and Sound Amplification Devices
It shall be unlawful for any person to operate any radio, loudspeaker, musical instrument, or other sound producing, sound reproducing, or sound amplification equipment which emits noise that can be heard from within closed residential structures located within 500 feet of the boundary of the property from which such noise emanates.
VIII. Penalty
A. Any person violating any provision of this chapter is guilty of a misdemeanor, and upon conviction thereof is punishable by a fine not to exceed three hundred dollars ($300) for the first offense, five hundred dollars ($500) for the second offense, and seven hundred fifty dollars ($750) for the third and all subsequent offenses.
