There seems to be a subtle and indirect abuse that single mothers suffer and that is the economic abuse perpetrated against them by fathers that are not supporting their children. Economic abuse is a real and critical component of Gender Based Violence (GBV). Many women stay in violent and abusive relationships because of the fear to not receive the financial support from the fathers, however the structures and efficiencies of the courts do not adequately capacitate women to receive maintenance on behalf of the minor children.

The pandemic has presented harsh conditions for mothers, with the loss of jobs affecting more women than men. Single mothers are facing the burden of unpaid maintenance more than ever and this is aggravated by corruption in courts, systematic delays, inefficiency of court officials, incompetency, shortage of staff members and bad attitudes towards mothers seeking maintenance.

It is with great disappointment that institutions that are designed to protect the rights of the children and further act as the guardians of the law and justice, fail the most vulnerable in society. The courts are slowly being perceived as toothless institutions that fail to deliver and apply the law as promulgated.
