In 2019 Gabriel was taken into state custody without proper procedure and under false pretenses and allegations made by a family member. The two female Phelps County children's division investigators and one male Saint James Missouri police officer entered my home and separately interviewed myself and another family member. After I had already been assaulted in that very home and it was documented by the same officer he returned and allowed Gabriel to remain with a family member and other tenants who assaulted me in that same home without background checks or a walk through. Paraphernalia pipes were left out in plain sight in the home that I documented and shared with a case worker. This led to an uncomfortable phone call from my son while I was attending therapy in Colorado Springs coping with the false allegations made by my husband, sister-in-law, and father-in-law to Fort Carson MP station and removal of my presence from my government leased home. Gabriel called me and told me that the tenants where he was left were blowing smoke in his face. Come to find out it was methamphetamines. The state immediately removed Gabriel from the home, and he began his journey in foster care. Why no charges were filed is still a mystery. We have been assigned since 2019 multiple case workers without any progress of reunification. The judge is the same judge for the divorce my husband decided to rush and file in a state where he did not even reside. I have been given a list of tasks to accomplish by the state and multiple case workers who have passed this case on, and it has been months since any progress has been made to reunify me and my son. When the state reached out to my husband, he told the state “There is a Catholic Boys Home in Jefferson City send him there.” Now as of 08/31/2021 Gabriel has taken a flight to visit Colorado for a week while his foster family vacations in another state. My son has made pleas with me in therapy sessions that he wants to come home and we are confined to a room for one hour a week in person visits. My attorney has filed a motion for asking for unsupervised visitation to take place. We are awaiting the hearing for further information. The state is quote “sitting on their hands” while I have met the requirements for visitation outside of the office where Gabriel and I visit for one hour every Wednesday.
