Miscarriage of Justice- The Brandon Davis Story
Brandon Davis was born on October 5,1994 he is 28 years old and has a whole life ahead of him. Brandon has foundational human qualities such as honesty, integrity, courage, self-awareness, and wholeheartedness. He is a father and is a man who likes to spend time with his family. Brandon demonstrates qualities of a good man with full support and back up from his family.
In 2013, a grossly unfair outcome occurred in a criminal proceeding against Brandon. Currently, he is serving a lifetime sentence for first degree murder, two counts of second degree murder, and assault in the first degree at an Upstate Correctional Facility located in New York.
The Fourteenth Amendment states that the government cannot deprive "any person of life, liberty, or property, without due process of law." This echoes the Fifth Amendment, which includes the same language along with protections against self-incrimination, double jeopardy, and others related to criminal proceedings. In this particular circumstance, the Fourteenth and Fifth Amendment rights were violated due to other circumstances related to criminal proceedings. There were no physical evidence Davis committed this crime.
Making any statement that is not true in an affidavit is technically a violation of the law and you can be fined or even imprisoned for committing perjury (the crime of being willfully untruthful under oath). Being truthful to the court is vital, whether communicating via an affidavit or in person on the stand. Brandon had false affidavits pinned against him without having a chance to show that the false statement or omission was made either knowingly and intentionally, and with reckless disregard for the truth.
The family of Brandon Davis is in support of him and is asking for an appeal in his case based on arguments that there were errors in the trials procedure and errors in the judge's interpretation of the law and exoneration.
