Sub: Removal of AIS-140:2016 VLT Standards

The central Government Insisted to implementation GSR No: 1095 (E) of Central Motor Vehicle (Twentieth Amendment) Rules 2016. They shall come into force on the 1st day of April 2018, were published.

Where the Draft rules as required under sub-section (1) of section 212 of the Motor Vehicle Act,1989(59 of 1988), wide Notification of the Government of India in Ministry of Road Transport and Highway number GSR 478(E) dated the 2nd May,2016.  “125-F under the Motor Vehicle Act 1988 (59 of 1988) shall be equipped with or fitted with vehicle Location tracking device, CCTV based surveillance system and one or more emergency button.

Under the views and opinions of the Ministry of road Transport stake holders, MoRTH released the Notification S.O. 1663(E) dated 18th April 2018. In exercise of the power conferred by clause )a) of Sub-section (3) of Section 110 of the Motor vehicles Act,1998 (59 of 1988), the Central Government hereby Exempts all public service vehicles from the Provision of rule 125H of Central Motor vehicle Act up to 1st day of April 2019.

We understand, another Notification S.O 5454(E) dated 25th Oct, 2018. Wherein this is now to be introduced only to new passengers vehicles and all the existing vehicles are not mandated and left to state.

Similarly, one more Notification S.O 5453(E) 25th October 2018. This order may be called as the Motor vehicle (vehicle Location Tracking Device and Emergency Button) order 2018. It specifies compulsory of AIS-140:2016 standard (VLT) for all public service vehicles.

Further the specification is mentioned with AIS-140:2016 under the Bureau of Indian Standards Act, 1986(63 of 1986). So, we suggest you that, there are no requirements of AIS-140:2016 standard VLT. Because it would create opportunity to generate monopoly market. Since the so many VLT devices marketing companies are already existed in the market from many years. Most of the travel operators are already using advance technology features in the devise, (Bio-Metric, Billing software connectivity, Security alert system, etc), implementing compulsory AIS-140:2016 will hamper and burden the existing business operators.    

We hope under such circumstance, Central Government Ministry of Road transport department should not make compulsory for only AIS-140:2016 VLT and make availability of device which are convenient for consumers.
