Banks financed homes of ordinary citizens with responsibility to validate claims on construction and monitor use of funds in hands of builder. Banks are substantially responsible for diversion of home buyer money by builder either by act of negligence or by being complicit . EMIs and interest payments by home buyers to banks till handover of homes must be stalled as a matter of justice to home buyers. The homebuyers continue to be troubled by double whammy of rentals and EMI payments for homes not handed over to them in sometimes more than 10 years. While RERA and NCDRC handle cases against builders through their long drawn processes infamously known to poor citizens, the infliction of EMIs and Interest payments on home loans continues to make home buyers ill, depressed and deprived. It is clear Banks are guilty of deficiency of service to their home loan customers by allowing diversion of funds / circular flow of funds back to banks and unapproved business (by givers of money viz. Home Buyers). The appeal is thus to Housing Minister and Chief Justice of India to take suo moto notice of state of home buyers and defer their payments of EMIs and Interest payments to banks till possession of delayed homes is done by builder .
