I arrived with my family in Australia 20 January 2011 on a student visa from South Africa. I came to study the Diploma of Disability which I successfully completed in December 2012. I was offered a Regional Employer Nominated (Permanent) Visa with LEAD, a large disability service provider in Canberra in October 2012 and I have been employed with them since then till present. My wife is also currently employed with LEAD, working as the Operations Manager – Employment assisting people with disabilities find employment in the labour market in Canberra. I applied for the Regional Employer Nominated (Permanent) Visa on 13 January 2013. Eight (8) months prior to applying for the permanent visa my wife, Jacqui was diagnosed with chronic kidney disease. On 12th September 2014 our permanent residency visa was refused on the basis that my wife did not meet the health criteria and would be a burden on the Australian economy. Our attorneys lodged an appeal with the Administrative Appeal Tribunal, Migration & Refugee Division (AAT-MRD) on 26 September 2014. The application before the Tribunal was refused on 19 February 2016 and the Tribunal noted in their refusal notification that we could make a request to the Minister of Immigration for a review of the decision. On 14th October 2016 we received an email informing us that the Assistant Minister for Immigration, the Hon. Alex Hawke MP has decided it's not in the public interest to intervene so our permanent residency visa has been refused and we were asked to leave Australia as soon as is practicable. I’ve applied for a permanent visa and now they’ve told me it’s been refused because of my wife’s chronic kidney disease. All we want to do is stay in Australia and keep working to improve the lives of socially isolated people with disability and to support our children who are completing their studies. Jacqui is not a burden to the Australian economy. She has been working since we arrived in Australia in 2011, her chronic kidney diagnosis did not deter her from full-time work and she has remained in gainful employment since 2011. We are valuable contributing members of the Australian society and will not be a financial burden on the Australian economy. The idea that we can’t contribute because of her condition is just wrong. We just need to be given a chance to prove it! We are settled in Australia and have adjusted very well to the Australian way of life. We have made lifelong friends. Australia is a fair country who gives everyone a fair go and we just want to be given a fair go to remain here in Australia permanently. Please sign and help me ask the Minister to reconsider our request for a permanent visa on compassionate and compelling grounds. This will enable us to continue our work in Australia in our chosen vocation to improve the lives of socially isolated vulnerable Australians. People with disability in Australia would benefit from our skills, dedication and passion.
