Vote No for Rezoning at Intersection of Hwy 24/27 and Riceland Way

Midland Town Council will vote on rezoning the 5 acre property at the left hand corner of 24/27 and Riceland Way (parcel xxxxx). The new owner of the property would like to sell it as a commercial property. (Be aware that across the street, a housing development is about to be built.) As residents and property owners on Riceland, there are concerns associated with this rezoning. We, signed below, are OPPOSED to the rezoning of this land. Our reasons are listed here:

1. The planning study commissioned by the town of Midland designates this property as residential. We who have chosen to live here, did not anticipate the town would be so quick to abandon it’s commissioned study in favor of increased tax revenue from a commercial property. This change is not in keeping with the vision the planners had for this area nor our expectation when choosing to live here.

2. Riceland Way is a private, residential road. It is owned and maintained by the property owners on the street at significant expense. We oppose the use of our road by commercial traffic. Even if allowances were made such as driveways directly onto 24/27, having a commercial property at this address will lead to increased traffic, turnaround traffic, and unwelcome use. We oppose the use of our private road for commercial traffic and damage/use from such traffic.

3. There are considerable deed restrictions applied to the properties on Riceland Way. The property in question was exempted from those deed restrictions by being REMOVED from the ‘subdivision’ WITHOUT going through the process outlined in the deed restrictions. Following that process would have required approval from the property owners on Riceland Way. Because the property was removed from the subdivision and its deed restrictions without following the outlined process, it should not be considered for anything other than the originally intended use.

4. Having a commercial property at the corner of our street devalues our property. Our property should not be devalued by a single property owner looking to capitalize on his purchase.
